DEPARTMENT: Planning and Building Services RECOMMENDED ACTION Adopt a resolution initiating proceedings for the North Valencia II annexation Storm Drainage Fee and set the public hearing for June 13, 2000; and rescinding the fee imposed on parcel number 2810-001-006. BACKGROUND In November 1996, California voters passed Proposition 218 — The Right to Vote on Taxes Act. As a result, the city must conduct a majority protest hearing and a ballot election for each area requesting annexation into the City to impose the stormwater fee on the associated parcels. On November 9, 1999, the City Council adopted Resolution 99-183 imposing storm drainage utility fees for the North Valencia II Annexation with the exception of certain properties listed in the Storm Drainage Fee Report 2. Adoption of this resolution would initiate proceedings required by state law to assess parcels within the proposed North Valencia 2 annexation not assessed November 9, 1999. Typically, Proposition 218 requires that if a new fee is imposed on a property, as a result of an annexation application, a majority protest hearing shall be held not less than 45 days after the mailing of the public notice. If no majority protest occurs, the city shall mail a public notice of the proposed fee with a ballot to all property owners and hold a public hearing not less than 45 days after the mailing of the public notice and ballot. If after the closing of the public hearing, property owners elect to impose a fee, the City Council may adopt a resolution canvassing ballots and imposing storm drainage utility fees. ALTERNATIVE ACTIONS No other alternatives have been identified by staff. Adopted: .K � o- o_A (o f FISCAL IMPACT The anticipated revenue from the parcels listed in the North Valencia II Fee Report 2 for the North Valencia II annexation area is currently $5,754.31. If the Storm Drainage Utility Fee is not adopted, the City's General Fund will have to pay the annual fee.
