If no majority protest exists, authorize staff to mail ballots to property owners and set election for August 22, 2000. BACKGROUND In November 1996, California voters passed Proposition 218 — The Right to Vote on Taxes Act. As a result, the city must conduct a majority protest hearing and a ballot election for each area requesting annexation into the City to impose the stormwater fee on the associated parcels. Proposition 218 also requires that the majority protest hearing be held prior to the ballot election, and that any protest to this fee must be submitted in writing to the City Council prior to the close of the public hearing. Should a majority protest exist, the process concludes and no fee may be imposed. If no majority protest exists the City must mail a public notice of the proposed fee with ballots to the property owners of record, and an election scheduled for a public hearing not less than 45 days after the mailing of the public notice and ballot. On November 9, 1999, the City Council adopted Resolution 99-183 imposing storm drainage utility fees for the North Valencia II Annexation with the exception of certain properties listed in the Storm Drainage Fee Report 2. On April 25, 2000, the City Council adopted Resolution 00-46, initiating proceedings for the remaining area of the North Valencia II Annexation, and setting the time and place for the required majority protest public hearing. ALTERNATIVE ACTION 1. No alternative action identified by staff. 2. Other action as determined by Council. FISCAL IMPACT The anticipated revenue from the parcels listed in the North Valencia II Fee Report 2 for the North Valencia II Annexation area is currently $5,754.31. If the Storm Drainage Utility Fee is not adopted, the City's General Fund will have to pay the annual fee. ATTACHMENTS Annexation Stormwater Fee Report 2 S:\PBS\ANNEX\NV2\STORM\nv2hi 2.dn CITY OF SANTA CLARITA NOTICE OF A PUBLIC HEARING TO CONSIDER North Valencia H Annexation SANTA CLARITA STORMWATER DRAINAGE SERVICES FEE NOTICE IS HEREBY GIVEN: A public hearing will be held before the City Council of the City of Santa Clarita to consider Stormwater Drainage Services Fee relating to a portion of the North Valencia II Annexation. The City Council of the City of Santa Clarita will conduct a public hearing at which any and all property owners of parcels subject to the proposed fee having objections to the imposition of the Stormwater Drainage Services Fee may appear and show cause why the fee should not be submitted to the qualified electors for a vote. The City Council shall consider all oral testimony and written protests. Written protests must be filed with the City Clerk prior to the conclusion of the Public Hearing. If written protests are presented by a majority of owners of the parcels subject to the proposed fee, the City will not impose the fee. The hearing will be held on the 13th day of June 2000, at or after the hour of 6:30 P.M. in the Council Chambers of the City Council in City Hall, 23920 Valencia Boulevard, Santa Clarita, California.
