SUBJECT: PUBLIC HEARING FOR THE SITE SPECIFIC STORM
DRAINAGE POLLUTION ABATEMENT FEE ELECTION
AND ADOPTING RESOLUTION CANVASSING BALLOTS,
IMPOSING SITE SPECIFIC STORM DRAINAGE
POLLUTION ABATEMENT FEE FOR THE SOUTH RIVER
DEVELOPMENT

City Council to continue the public hearing on this item to the March 28, 2000
meeting.
BACKGROUND
At the meeting of February 22, 2000, the City Council adopted an ordinance
amending Title 15, Chapter 15.50 of the Santa Clarita Municipal Code Entitled:
Storm Drainage Utility Enterprise Fund. The ordinance amendment gave the City
of Santa Clarita the authority to establish a system of specific user charges for any
water quality facilities that are site specific. These charges would be in addition to
the established Storm Drainage Pollution Abatement Charge that is levied to all
parcels in the City and would be established on a case by case basis, based on the
annual cost to maintain, operate, improve and/or replace the facilities.
Two developments, Bridgeport West of McBean Parkway and South River, have
decided to take a proactive role in becoming compliant with the new National
Pollution Discharge Elimination System (NPDES) Permit. As an alternative to
directing their urban runoff to flow into the City's storm drain system, these
developments will direct urban and storm runoff into a filter detention basin. Both
developments have requested that the City of Santa Clarita maintain, operate,
improve and/or replace the facility. In order to properly fund these actions, a Site
Specific Storm Drainage Pollution Abatement fee is needed. Per the requirements of
Proposition 218, a majority public hearing is necessary. Additional time is needed to
complete the Proposition 218 process and a continuance to the meeting of March 28,
2000 is requested. ///►►►

RESOLUTION CANVASSING BALLOTS, IMPOSING SPECIFIC STORM
DRAINAGE UTILITY FEES FOR THE SOUTH RIVER DEVELOPMENT
NOTICE IS HEREBY GIVEN:
A public hearing will be held before the City Council of the City of Santa Clarita to
consider: The Site Specific Storm Drainage Election and Adopting Resolution
Canvassing Ballots, Imposing Specific Storm Drainage Utility Fees for the South
River Development. The proposed resolution establishes the site specific storm
drainage fees for the South River development. Urban runoff and stormwater from
the development will be diverted to a filter detention basin for treatment and
storage. In order for the City of Santa Clarita to properly fund the maintenance of
this water quality facility, a site specific storm drainage fee is needed. Only the
residents of the South River development will be required to pay this fee which is in
addition to the stormwater fee levied on all residences in the City of Santa Clarita.
Per the requirements of Proposition 218, a majority public hearing is necessary.
The hearing will be held in the City Council Chambers, 23920 Valencia Boulevard,
1' Floor, Santa Clarita, California, on the 14' day of March, 2000 at or after 6:30
p.m.
Proponents, opponents and any interested persons may be heard on this matter at
this time. Further information may be obtained by contacting Marika A. Modugno

If you wish to challenge the action taken on this matter in court, you may be limited
to raising only those issues you or someone else raised at the public hearing
described in this notice, or in written correspondence delivered to the City of Santa
Clarita, at, or prior to, the public hearing.

NOTICE IS HEREBY GIVEN that the City Council of the City of Santa Clarita, at its
regular meeting held March 14, 2000, continued a public hearing on

THE SOUTH RIVER DEVELOPMENT — The proposed resolution establishes the site specific storm
drainage fees for the South River Development. Urban runoff and stormwater from the development
will be diverted to a filter detention basin for treatment and storage. In order for the City of Santa
Clarita to properly fund the maintenance of this water quality facility, a site specific storm drainage
fee is needed. Only the residents of the South River development will be required to pay this fee which
is in addition to the storm drainage fee levied on all residences in the City of Santa Clarita. Per the
requirements of Proposition 218, a majority public hearing is necessary. If after the closing of the
public hearing, property owners elect to impose a fee, the City Council may adopt the resolution
canvassing ballots and imposing specific storm drainage utility fees.
RECOMMENDED ACTION: Continue the public hearing to the March 28, 2000 Council meeting.
