HomeMy WebLinkAbout2000-10-24 - AGENDA REPORTS - UDC AMEND (2)AGENDA REPORT City Manager Approval Item to be presented b .rBertoni PUBLIC HEARING DATE: October 24, 2000 SUBJECT: AMENDMENT TO SECTION 17.15.020 OF THE UNIFIED DEVELOPMENT CODE DEPARTMENT: Planning and Building Services RECOMMENDED ACTION The City Council receive staff presentation, receive public testimony, close the public hearing, discuss and approve a Resolution to adopt the negative declaration, introduce an Ordinance, and pass to second reading on November 14, 2000. BACKGROUND On May 11, 1999 the Council adopted Ordinance 99-4. This ordinance amended Section 17.15.020.A.2 of the City's Untied Development Code, which prohibited recreational vehicles from being parked within the 20 -foot front yard setback of residential lots. On February 8, 2000, the City Council adopted Ordinance 00-3. This ordinance amended various sections of the City's Unified Development Code. Ordinance 00-3 contained approximately 200 changes that codified City policies, director's interpretations and definitions of frequently used terms not contained in the Code. Both ordinances included regulations based on comments that planning staff received from the public, Planning Commission, and City Council. The required public hearings for each ordinance were held and public testimony was taken. The City Council passed and adopted the ordinance and subsequent attachments containing the wording that would be reflected in the Unified Development Code. ANALYSIS Ordinance 00-3 was written prior to staff's receipt of the codified update to the Unified Development Code made by Ordinance 99-4. Ordinance 00-3 amended wording in section 17.15.020.A.2. that was in the Unified Development Code prior to the adoption of Ordinance 99-4, therefore, Ordinance 00-3 mistakenly amended Ordinance 99-4 and unintentionally removed any changes to the Unified Development Code made by Ordinance 99-4. A notice of exemption was prepared and circulated for public review. Environmental analysis of each of the previous ordinances was conducted and circulated for public review prior to the Council's review and adoption of the ordinances.
