SUBJECT: SUMMARY VACATION OF PUBLIC SERVICE EASEMENT (STORM
DRAIN) — LOT 19, TRACT NO. 51931-02 (JPI APARTMENTS)

City Council adopt a resolution for the summary vacation of the storm drain easement as
shown on the attached exhibits; and direct City staff to record a certified copy of the
original resolution in the office of the Registrar -Recorder of the County of Los Angeles.
This agenda item is requesting City Council approval of the vacation of a public service
easement (storm drain). The subject easement was granted to the County of Los Angeles in
February 1982 as Instrument No. 82-126203 for the construction of Private Drain No. 1595,
Parcel Map No. 8405. The easement was to be used for an inlet structure to allow storm
water to travel under Magic Mountain Parkway. However, Private Drain No. 1595 was
never constructed. A new parcel map (Parcel Map No. 62206) was recorded over and
replaced Parcel Map No. 8405. The easement is no longer necessary because the drainage
for the new tract has been redesigned.
The existing storm drain easement was never used, never vacated, and is now located on
Lot 19 of Tract No. 51931-02. Since this storm drain easement is not being used for its
designated purpose, the developer, JPI Apartments, requests that it be vacated in order to
clear the property title. Staff finds that this is a feasible request and recommends
approval.
Under Section 8333 of the Streets and Highways Code, the legislative body of a local agency
may summarily vacate a public service easement if the easement has not been used for the
purpose for which it was dedicated or acquired for the last five years immediately preceding
the proposed vacation.
