SUBJECT: SUMMARY VACATION OF PORTION OF ROAD AND SLOPE
EASEMENT AT 23707 WILDWOOD CANYON ROAD

RECOMMENDED ACTION
City Council adopt a resolution for the summary vacation of those portions of
Wildwood Canyon Road and slope easements as shown on the attached exhibit; and direct
City staff to record a certified copy of the resolution in the office of the Registrar -Recorder of
the County of Los Angeles, subject to the execution of and irrevocable offers of dedication
for street purposes and for public trails over the existing private access easement.
BACKGROUND
On June 12, 2000, the City received a request from the owner of the property located at
23707 Wildwood Canyon Road to vacate a portion of a public road and slope easement over
his property. Prior to the sale of the property, City staff met with the owner and his
representatives to discuss the issue of the public easements on the property he was about to
purchase. The subject road and slope easements were recorded on April 29, 1987, as
instrument nos. 87 672387 and 87 2386, respectively. The easements provide future public
access for properties south of this location. Please see Exhibit "A," Location Map.
The public easements have not been used for access purposes. Instead, access is provided
through an existing paved asphalt road. Information provided by the owner of the subject
property indicates that if the unused public easements are vacated, an existing private
easement covering the limits of the asphalt road will continue to provide access to these
properties.
To ensure public access and uses through the site if needed at some future date, an
Irrevocable Offer of Dedication for public road purposes has been made by the owner.
While there are no current plans for development, it would be prudent for the City to
protect public access rights in the area. This 32 -foot -wide strip covers the limits of the
existing asphalt road. In addition, an easement for a future trail alignment linking
potential trails in the Wildwood Canyon area to the proposed trails in the Needham Ranch
area is needed across the parcel. In response to these trail requirements, the owner has

also granted to the City an Irrevocable Offer to Dedicate an easement for trail purposes.
This easement follows the same alignment of both the private access easement and the
public road offer.
Under Section 8334 of the Streets and Highways Code, the legislative body of a local agency
may summarily vacate a public service easement if both of the following conditions exist:
(a) for a period of five consecutive years, the street or highway has been impassable for
vehicular travel; and (b) no public money was expended for maintenance on the street or
highway during such period. The subject easements meet the above criteria for vacation.
Although the Streets and Highways Code does not require the City to do so, consistent with
the City Council's expectation of keeping residents informed of land use decisions, staff
provided notification to all affected property owners of the proposed vacation via certified
mail. Of the thirteen notices sent, twelve receipts have been returned and five responses
have been returned. Three of the five responses favor the proposed vacation, one does not,
and one was incomplete.
Two property owners who responded in favor of the vacation have expressed an interest in
vacating the same slope and road easement that crosses their property. In order to bring
the current request to Council at the earliest possible date, the other vacation requests
were not included. Staff expects to receive formal requests from the property owners at a
later date.
Staff also notified all affected utility companies. All utility companies that responded have
no facilities that will be affected or have no objections with the proposed vacation.
