SUBJECT: WILEY CANYON ROAD REALIGNMENT — PROJECT ACCEPTANCE —
PROJECT NO. S2020

RECOMMENDED ACTION
City Council accept the work performed by Gueno Development, Inc. on the Wiley Canyon Road
Realignment, Project No. S2020; direct the City Clerk to file the attached Notice of Completion;
and direct staff to release the 10 percent retention 35 days after the Notice of Completion is
recorded, provided no stop notices as provided by law have been filed.
BACKGROUND
On August 25, 1998, the City Council awarded a contract for the Wiley Canyon Road
Realignment to Gueno Development, Inc. This project includes construction of two travel lanes
using the eastern portion of right-of-way, curb, gutter, and a seven -foot sidewalk on the eastern
side of the road, a five-foot paved shoulder lane adjacent to the curb for bicycle use, an asphalt
walk area on the western side from Powell Street to Wabuska Road, and a concrete retaining
wall to relieve the existing slope grade impacts on the roadway. The counterfort retaining wall
is stepped back into the hillside slightly to allow for irrigation and planting of "cells" in the wall.
This work was completed by Gueno Development, Inc. on December 3, 1999 and accepted by the
City Engineer on March 16, 2000.

Other action as determined by the City Council.
FISCAL IMPACT
Total multi-year expenditure for Wiley Canyon Road Realignment, Project No. S2020, is
$1,980,000.00 and includes the construction cost, including material testing and inspection fees,
and all costs associated with the design. The construction cost for this project is $1,573,821.56.
This cost does not include inspection, project management, and attorney fees.

The total budget for Project No. 52020 is $2,029,208.00. Currently, the City is in receipt of the
claim submitted by Gueno Development, Inc. for the approximate amount of $960,000.00. City
staff is in the process of determining the claim validity, as well as the correctness of the claim
amount. Staff is working with all associated parties to settle this claim.
