Call To Order: 5:30 p.m.
Roll Call: All Councilmembers were present.

ITEM 1 PORTA BELLA CLEAN-UP, RESTORATION & DEVELOPMENT
PROJECT — Jeff Lambert, Director of Planning & Building Services, gave
an overview of the topics to be discussed and introduced Bob Sagehorn,
General Manager of the Castaic Lake Water Agency, who outlined the
process to clean and correct the problem with perchloratea at a cost of
approximately $35 million. He also announced that a lawsuit had been filed
today in Los Angeles County Superior Court against Santa Clarita LLC and
Whitaker-Bermite to assume financial responsibility for the cleanup of the
Porta Bella property. The City was not named as a defendant in the lawsuit.
Alan Berg, Site Restoration Director for Remediation Financial, made a
presentation on the exiating groundwater conditions. Chris Ross of Hargis &
Associates provided information on the groundwater investigation and Kevin
Coons of Hargis & Associates provided information on potential perchlorate
technologies. John Hahn of Mayer, Brown & Platt, legal counsel for Santa
Clarita LLC, provided additional information.
Council questions and concerns included: whether there are other potential
sites where a problem. with perchlorates exist; getting copies of reports and
other information.
Mayor Darcy called for public participation.
Those addressing the Council on topic were Chris Townsend, Connie Worden-Roberts, Allan
Cameron, Adam Ford, and Jennifer Kilpatrick
Carl Newton, City Attorney, requested the Council consider calling a recess to conduct a
closed session.
Motion by Weste, second by Kellar, to add a Closed Session to the agenda
under Government Code Section 54956.9 (b) to discuss whether the City
may be a party to litigation, finding that the need for the Closed Session is
immediate and arose subsequent to the posting of the agenda
On roll call vote:
Ayes: Smyth, Weste, Ferry, Kellar, Darcy
Noes: None
Absent: None
Motion carried.
Mayor Darcy recessed the meeting to Closed Session at 7:29 p.m. and reconvened the
meeting at 7:52 p.m.
Carl Newton, City Attorney, announced that no action was taken during the Closed Session
that was required to be reported. Further recommendation was made to cancel the
remainder of the agenda regarding liability.
Motion by Weste, second by Smyth, to cancel the remainder of the agenda.
On roll call vote:
Ayes: Smyth, Weste, Ferry, Kellar, Darcy
Noes: None
Absent: None
Motion carried.
Mayor Darcy adjourned the meeting at 7:54 p.m.
