AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLAR.ITA
APPROVING ZONE CHANGE NO. 99-001 (MASTER CASE 97-143)
FOR THE NEWHALL PARTNERS GOLDEN VALLEY ROAD PROJECT
LOCATED SOUTHEAST OF SIERRA HIGHWAY AND WEST OF THE GREEN
MOUNTAIN DRIVE/GOLDEN VALLEY ROAD INTERSECTION
WHEREAS, the City Council does hereby make the following findings of fact:
a. The applicant proposed and initiated a zone change of certain uninhabited property
located southeast of Sierra Highway and west of the Green Mountain Drive/Golden
Valley Road intersection as described and shown on Exhibit A, for the purpose of
designating a (PD) Planned Development Overlay Zone on 61.23 acres of Residential
Suburban (RS) zoning.
b. Such a Zone Change would become effective upon City Council approval and
certification of the Environmental Impact Report.
C. The Planning Commission held duly noticed public hearings on the Newhall
Partners Golden Valley Road project entitlements, including Zone Change 99-001 on
July 18, 2000, and continuing on July 26, August 1, September 6, September 19,
►�- 2000, and October 3, 2000. The Planning Commission closed the public hearing on
September 19, 2000 and continued the item to the October 3, 2000 meeting for the
purposes of finalizing their recommendation to the City Council. On October 3,
2000, the Planning Commission adopted a recommendation that the City Council
not accept the applicant's project of 176 units and instead approve VTTM 48892 (147
Unit Code Compliant Alternative 3 Project identified in EIR), consider the Final
Environmental Impact Report (FEIR), and ultimately certify the FEIR, approve the
oak tree permit, and deny the zone change, conditional use permit, and variance.
Notice of said public hearings was given in the manner required by the Santa
Clarita Municipal Code and State law.
d. The City Council held duly noticed public hearing on the Newhall Partners Golden
Valley Road project entitlements, including Zone Change 99-001 on October 24, 2000
which resulted in the item being continued to November 28, 2000
WHEREAS, based upon the testimony and other evidence received at the hearing, and
upon the study and investigation made by the Planning Commission and City Council and
on its behalf, the City Council further find as follows:
a. The purpose of the proposal is to Zone Change the project site from Residential
Suburban (RS) to Residential Suburban Planned Development RS(PD) zone.
b. That the Zone Change has been reviewed for consistency with the City's General
Plan.

C. Public participation and notification requirements pursuant to Sections 65090 and
65391 of the Government Code of the State of California were duly followed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Based upon the foregoing facts and findings in the Initial Study
prepared for the project, the City Council determines as follows:
a. Said study found that the project would have an adverse impact to the existing and
future environmental resources of the area and an environmental impact report was
prepared.
b. On October 3, 2000, the Planning Commission adopted a recommendation that the
City Council approve VTTM 48892, consider the Final Environmental Impact Report
(FEIR), and ultimately certify the FEIR and adopt various entitlements, including
the zone change. On November 28, 2000, the City Council certified the FEIR and
adopted the Statement of Overriding Considerations by separate Resolution.
SECTION 2. The City Council has considered certain principals and standards, and
determines as follows:
a. That a need for the Zone Change to RS(PD) zoning does exist within the area of the
subject property and is consistent with the General Plan, Development Code, and
development policies of the City of Santa Clarita.
b. That public necessity, convenience, general welfare and good planning practice
justifies the Zone Change classification to RS(PD) based upon existing land uses and
geographical features.
SECTION 3. The City Council hereby approves Zone Change 99-001 consisting of
the Newhall Partners Golden Valley Road project area to Residential Suburban Planned
Development RS(PD). A map of the zone change is on file in the Planning Division.

SECTION 4. This Ordinance shall become effective at 12:01 a.m. on the thirty-first
day after adoption.
SECTION 5. The City Clerk shall certify as to the passage of this Ordinance and
cause it to be published in the manner prescribed by law.
