HomeMy WebLinkAbout2000-01-25 - ORDINANCES - NORTH VALENCIA 2 ANNEX PREZONE (2)ORDINANCE NO. 00-1 AN ORDINANCE OF CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING PREZONE 98-003 (MASTER CASE 98-183) FOR ANNEXATION NO. 98-02 (NORTH VALENCIA NO. 2) TO ALLOW FOR THE NORTH VALENCIA NO. 2 SPECIFIC PLAN, WHICH CHANGES THE ZONING CLASSIFICATION FROM LOS ANGELES COUNTY ZONES A-2-5, RPD 5000 - 8.6U, AND M -PD TO CITY OF SANTA CLARITA ZONE SPECIFIC PLAN (SP) OVER 596.2 ACRES AND AMENDS PORTIONS OF ORDINANCE 99-2, AND ADOPTION OF THE NORTH VALENCIA NO.2 SPECIFIC PLAN TO ESTABLISH SPECIAL DEVELOPMENT STANDARDS TO ALLOW FOR THE DEVELOPMENT OF A 596.2 ACRE PROPERTY KNOWN AS THE NORTH VALENCIA NO. 2 SPECIFIC PLAN AREA LOCATED WITHIN THE 576.2 ACRE NORTH VALENCIA 2 ANNEXATION AREA IN THE UNINCORPORATED AREA OF LOS ANGELES COUNTY ADJACENT TO THE CITY OF SANTA CLARITA. THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. FINDINGS OF FACT- The City Council does hereby make the following findings of fact: a. The North Valencia No. 2 Annexation area is approximately 576.2 acres and is generally located north of Newhall Ranch Road, west of McBean Parkway, and -. south and east of Copperhill Drive/Rye Canyon Road, in the unincorporated area of Los Angeles County adjacent to the City of Santa Clarita. The North Valencia No. 2 Specific Plan area is approximately 596.2 acres and has a contiguous boundary with the North Valencia No. 2 Annexation area. Of the 596.2 -acre project site and annexation area, approximately 391.2 acres are to be developed with new uses. The remaining 205 acres have been previously developed or have been entitled through the jurisdiction of the County of Los Angeles. The North Valencia No. 2 Specific Plan area contains commercial uses, light industrial uses, and Valencia high School, although a majority of the site is vacant. The site is generally flat, although hillside features do occur on portions of the project's Decoro South planning subarea six, as well as in the Eastcreek planning subareas one and four. These hillside features exceed 15% grade but are not shown to have either major or secondary ridgeline status on the City's Ridgeline Map. In the past, portions of the property were used for agricultural purposes, and for sludge disposal in conjunction with agricultural uses. Major features of the annexation area include San Francisquito Creek, a portion of the San Gabriel Fault Alquist-Priolo Special Studies Zone, the Metropolitan Water District property and pipeline, as well as electrical transmission corridors. b. Approved in July 1998 and signed in January 1999, the City and the Valencia Company entered into a non-binding Memorandum of Understanding (MOL) regarding certain aspects of the potential annexation of approximately 1,054 acres of unincorporated territory in the North Valencia area. The annexation of this territory was to include two separate annexations to be processed concurrently, the North Park area and the North Valencia No. 2 Annexation area. At the time the MOU was adopted, the applicant stated their intention to Ord No. Page 2 request entitlement for up to 2,500 dwelling units and a maximum of 310,000 square feet of commercialimixed uses. The annexations proposed included the following existing Los Angeles County approved entitlements: 92,000 square foot NorthPark shopping center, 67,000 square foot Plaza Del Rancho shopping center, 80,000 square foot retail center at the northeast corner of Copper Hill Drive and Newhall Ranch Road, approximately 45 acres of industrial property within the Valencia Industrial Center south of Smyth Drive, tentative tract 45440 (North Park) and tentative tract 46389 (North Park). C. The applicant formally requested certain project entitlements on August 17, 1998 (Master Case 98-183). Entitlements requested include the following: an amendment to the General Plan Land Use Map (GPA 98-002"A") to designate approximately 576.2 acres of the North Valencia 2 Annexation Area to a Specific Plan (SP) land use designation and an amendment to the Circulation Element (GPA 98-002 "B") to allow modification of the cross sections for certain roadways on the Master Pian of Arterial Highways through adoption of a specific plan; a Specific Pian Prezone and adoption of a North Valencia No. 2 Specific Plan document (text) to cover approximately 596.2 acres including the North Valencia 2 Annexation area and the Decoro Drive Bridge area and requests for up to 1,900 dwelling units and 210,000 square feet of commercial uses (PZ 98-003); annexation requests to annex the 576.2 acre North Valencia 2 Annexation area (Annexation No. 98-02, uninhabited); Vesting Tentative Tract Map 44831 "A" (Eastcreek), and Vesting Tentative Tract Map 44831 "B" (Eastcreek); Vesting Tentative Tract Map 52667 (Decoro South); a Conditional Use Permit to allow for grading of over 100,000 cubic yards, a haul route, construction of multi -family structures up to 38 feet in height within two North Valencia No. 2 Specific Plan planning sub -areas and access gates for the private streets in North Valencia No. 2 Specific Plan Eastcreek sub -area four (CUP 98-006); an Oak Tree Permit to allow for removals of oak tree numbers 15, 16, 17, and 18 necessary for site preparation and construction and encroachment upon or removal of oak tree numbers 50, 51, 52, 54, and 55 as needed to construct the bridge at Decoro Drive (OTP 98-020); an Annexation and Development Agreement providing the public with certain "above and beyond" benefits and the applicant with certain benefits including a 15 -year project build -out (DA 98-001); and a request for an initial study to determine the appropriate environmental review for the project. On March 1, 1999, the applicant submitted an additional entitlement request (Master Case No. 99-055) for a Hillside Review Permit to allow for grading on slopes in excess of 15% grade (HR 99-002). d. A prezone (PZ98-002, MC98-183) was approved on February 9, 1999 by the City Council for an 1,054 acre area covering the area known as the North Valencia No. 2 area through Ordinance No. 99-2. The North Valencia No. 2 area prezone includes the area known as the North Valencia No. 2 Specific Plan and North Valencia 2 Annexation area (Annexation No. 98-02) and the North Park Annexation (Annexation No. 98-03) area. The prezones assigned through Ordinance No. 99-2 are consistent with the City's existing General Plan. In adopting Ordinance No. 99-2 for the prezone, the Council found that the subject Ord No. Page 3 property is in a proper location for zones Business Park (BP), Community Commercial (CC), Commercial Neighborhood (CN), Residential High (RH), Residential Medium High (RMH), Residential Suburban (RS), Residential Low (RL), and Residential Estate (RE) as identified on the City's Zoning Map, consistent with the location of the BP, CC, CN, RH, RMH, RS, RE and RL land use designations on the City's General Plan Land Use Map. e. While processing the 1,054 -acre North Valencia No. 2 area prezone that occurred in February 1999, the City simultaneously processed the remaining entitlement requests that were subject to environmental review. This included processing of a subsequent prezone request (PZ98-003) to amend portions of 1,054 acres previously prezoned to establish the City of Santa Clarita prezone Specific Plan (SP) over the 596.2 -acre North Valencia No.2 Specific Plan area. The acreage in the North Park Annexation area would remain as prezoned by Ordinance No. 99- 2. f. The North Valencia No. 2 Specific Plan and Annexation development entitlement application included a request for approval of a Specific Plan Document (text) that includes up to 1,900 dwelling units; 210,000 square feet of new commercial/mixed uses; a 20 -acre junior high school site; a 15.9 -acre public park; a 3.5 -acre undeveloped Los Angeles County park site given to the County as a condition of approval for the North Park development; 4.1 acres of private recreation areas; 93.4 acres of open space (47.5 acres of San Francisquito Creek and 45.9 acres of undeveloped upland preserve zone); two trailhead staging areas, 1.7 acres of paseos, and 7.3 acres of community trails. The North Valencia No. 2 Specific Plan Document includes an analysis of consistency between the Specific Plan and the City of Santa Clarita General Plan. The North Valencia No. 2 Specific Plan Document is consistent with the City of Santa Clarita General Plan. The North Valencia No. 2 Specific Plan Document contains two different land use alternatives for the Eastcreek Planning area, the project and Option B. The project includes the future junior high school and joint public park on SP - Commercial zoning (SP -Com) at the northwest corner of Newhall Ranch Road and McBean Parkway in Eastcreek Sub -area One and 150,000 square feet of mixed uses and up to 250 attached residential units on SP -Mixed Use zoning (SP -MU) at the northwest corner of McBean Parkway and Decoro Drive in Eastcreek Sub -area Three. Option B includes 50,000 square feet of mixed uses and up to 250 attached residential units on SP -Mixed Use zoning (SP -MU) at the northwest corner of Newhall Ranch Road and McBean Parkway in Eastcreek Sub -area One and the future junior high school and joint public park on SP - Commercial (SP -Com) at the northwest corner of McBean Parkway and Decoro Drive in Eastcreek Sub -area Three. The decision of which land use option is built rests with the ultimate location of the future junior high school. Consultation has occurred with the William S. Hart Union High School District and it is believed that the District may favor the site at the northwest corner of McBean 3 Ord No. Page 4 and Decoro Drive (Option B site) or another location outside the Specific Plan area. Should the William S. Hart Union High School District decide neither site in the North Valencia No. 2 Specific Plan area is suitable for a junior high school, then a third land use plan is provided that allows mixed use and a minimum 15.9 -acre Community Park at either of the school site locations. The North Valencia No. 2 Specific Plan Document includes exhibits and discussion of the distribution, location, and extent of the uses of land, including open space, within the area covered by the Specific Plan. Proposed land uses within the North Valencia No. 2 Specific Plan Document coordinate with proposed uses outside the Specific Plan area such as the River Trail, the Upland Preserve Zone, and General Plan roadway connections. The North Valencia No. 2 Specific Plan Document includes the proposed distribution, location, and extent and intensity of major components of public and private transportation, recreational parklands and trails, open space, sewage, water drainage, solid waste disposal, energy, and other essential facilities and public services proposed to be located within the area covered by the plan and needed to support the land uses described in the plan. The North Valencia No. 2 Specific Plan Document includes standards and criteria by which development will proceed, and standards for the conservation, development, and utilization of natural resources, where applicable. These Specific Plan standards and criteria reflect those of the City and will provide for a comprehensively planned community under the goals and policies of the City. Thus, development within the Specific Plan area will be superior to piecemeal development under Los Angeles County development standards. The North Valencia No. 2 Specific Plan includes a program of implementation measures including regulations, public works projects, and provisions for financing measures necessary to carry out public improvements. Conditions of approval for the project associated with related North Valencia No. 2 Specific Plan entitlements, particularly the annexation and development agreement and subdivision maps, provide necessary infrastructure to serve the Specific Plan area and mitigate potential environmental impacts as identified in the Mitigation, Monitoring and Reporting Program prepared for this project. g. The North Valencia No. 2 Specific Plan and Annexation development entitlement application included a request for approval of two vesting tentative tract maps, one of those with two tentative tract options. Vesting Tentative Tract Map 44831 "A" and 44831 "B" cover the Specific Plan areas known as Eastcreek and San Francisquito Creek. The primary difference between the two options of VTTM 44831 is the location of a future junior high school site. VTTM 44831 "A" includes 297.2 acres and 36 lots. VTTM 44831 "B" includes 297.2 acres and 34 lots. VTTM 44831 "B" has a larger developable acreage than the "A" option due to increased encroachment into the creek area in order to provide the necessary acreage for a junior high school. The total number of units proposed for both 4 Ord No. Page 5 VTTM 44831 "A" and "B" is 1,200 dwelling units with unit type as allowable as described in the North Valencia No. 2 Specific Plan Document. VTTM 44831 "A" shall be the applicable map if a public school is not located within the North Valencia No. 2 Specific Plan area. h. The North Valencia No. 2 Specific Plan and Annexation development entitlement application included a request for approval of a second vesting tentative tract map for VTTM 52667 covering the Specific Plan area known as Decoro South. VTTM 52667 includes 91.5 acres and 13 lots. The total number of units proposed for VTTM 52667 is 700 dwelling units. i. The North Valencia No. 2 Specific Plan and Annexation development entitlement application included a request for approval of an Annexation and Development Agreement to provide the applicant with certain benefits including a 15 -year project build -out in exchange for providing "above and beyond" public benefits (DA 98-001). Provisions of the North Valencia No. 2 Annexation and Development Agreement require orderly construction of public infrastructure necessary to serve development within the Specific Plan area. j. Los Angeles County is presently processing an entitlement request for the West Creek project (TT 52455). Proposed VTTM 44831 (Eastcreek) and TT52455 (West Creek) will share a common boundary that will become a City boundary upon recordation of either of these maps and annexation of the North Valencia No. 2 area to the City of Santa Clarita. As proposed, the remaining boundaries of the proposed North Valencia No. 2 Annexation area follow existing legal lot lines and roadway centerlines. k. On June 25, 1991, the City Council adopted Resolution No. 91-98, adopting the General Plan of the City of Santa Clarita and certifying the Environmental Impact Report. The City's General Plan presently designates the annexation area as Business Park (BP), Community Commercial (CC), Commercial Neighborhood (CN), Residential High (RH), Residential Medium High (RMH), Residential Suburban (RS), Residential Low (RL), and Residential Estate (RE) with a Valley Center Concept WCC) Overlay on a portion of Eastcreek Sub -area One and a Significant Ecological Area (SEA) Overlay over San Francisquito Creek. (Existing City General Plan -Land Use Designations, acreages and development potential are shown in Table 2-1 of the North Valencia No. 2 Specific Plan). The General Plan does not specifically mention the North Valencia No. 2 site as an area ideal for a specific plan; however, the site meets the minimum Specific Plan size of 100 contiguous acres under single ownership as identified in the Specific Plan zoning standards of the City's Unified Development Code. Zoning on the site is presently Los Angeles County zones A-2-5, RPD -5000-8.6U, RPD - 5000 -5U, RPD -5000-7.8U, RPD -5000-16U, C-3 and MPD and has already been prezoned City of Santa Clarita zones CC, CN, BP, RE, RL, RS, RMH and RH. Ord No. Page 6 1. The City Council authorized the filing of an annexation request with LAFCO on June 23, 1999 (Resolution 99-127). The City filed an application for annexation of the area with the Los Angeles Local Agency Formation Commission (LAFCO) in July 1999. The City's annexation request is processing at LAFCO at the request of the City and the applicant pending the approval and certification of FEIR SCH#98111201 prepared for this project, election of this area into the City's Stormwater Utility and approval of related project entitlements by the City Council. M. On November 9, 1999 the City held a Stormwater Utility Fee election for a portion of the North Valencia 2 Annexation area. This election passed and a Stormwater Utility Fee will be applied to this area following annexation into the City. Only a portion of the North Valencia No. 2 Annexation area was included in this election due to errors in the records of the Los Angeles County Assessor's Office. A second Stormwater Utility Fee election to cover the remaining North Valencia No. 2 Annexation area is (portion of North Valencia No. 2 Specific Plan Subareas 3 and 4) will be held in Winter -Spring 2000, prior to annexation of this area to the City. n. Article 8-- Specific Plans Sec. 65451 of the California Government Code defines the contents which must be included in a specific plan as follows: (a) A specific plan shall include a text and a diagram or diagrams which specify all of the following in detail: (1) The distribution, location, and extent of the uses of land, including open space, within the area covered by the plan. (2) The proposed distribution, location, and extent and intensity of major components of public and private transportation, sewage, water drainage, solid waste disposal, energy, and other essential facilities proposed to be located within the area covered by the plan and needed to support the land uses described in the plan. (3) Standards and criteria by which development will proceed, and standards for the conservation, development, and utilization of natural resources, where applicable. (4) A program of implementation measures including regulations, programs, public works projects, and financing measures necessary to carry out paragraphs (1), (2), and (3). (b) The specific plan shall include a statement of the relationship of the specific plan to the general plan. o. Section 17.16.030 of the City's Unified Development Code (UDC) identifies general requirements and performance standards for a specific plan zone. A Ord No. Page 7 Specific Plan Zone shall: (a) Include a minimum of 100 contiguous acres. (b) Be determined by the Council after considering the recommendation of the Planning Commission. (c) Provide for the development of a comprehensively planned community within the zone that is superior to development otherwise allowable under alternate regulations. (d) Provide for development within the zone in a manner consistent with the General Plan and with related development and growth policies of the City. (e) Provide for the construction, improvement, or extension of transportation facilities, public utilities, and public services required by development within the zone. P. The City Council held a study session on January 5, 1999 and received an informational report on the status of the North Valencia No 2 Specific Plan and entitlements and the North Valencia 2 and NorthPark Annexations. The City Council was presented with the results of a fiscal impacts analysis of the North Valencia 2 Annexation and the North Park annexation that showed that these annexations would be, at least, marginally positive five years following commencement of the project. A second City Council study session was held on July 6, 1999, following the close of the DEIR public comment period, to receive an update on the status of the Planning Commission's processing of the North Valencia No. 2 Specific Plan and entitlements and North Valencia 2 Annexation project. t. The Planning Commission held duly noticed public hearings on the North Valencia 2 Annexation and North Valencia No. 2 Specific Plan and related entitlements including the presone commencing on March 30, 1999 and continuing on April 6, April 15, April 20, April 29, May 4, May 13, May 18, June 15, June 17, June 29, July 8, July 15, July 20, 1999, August 10, 1999, September 2,1999, September 9, 1999 and September 16,1999. The Planning Commission closed the public hearing on September 16, 1999 and continued the item to the meetings of September 21, 1999 and September 28, 1999 for the purposes of finalizing their recommendation to the City Council. On September 28, 1999, the Planning Commission adopted a recommendation that the City Council certify the Final Environmental Impact Report and adopt an ordinance approving the requested entitlements including the prezone to the Specific Plan (SP) Zone, the North Valencia No. 2 Annexation, and the North Valencia No. 2 Specific Plan Document. U. The first City Council public hearing for the North Valencia No. 2 Specific Plan and related entitlements including the prezone and Specific Plan Document and 7 Ord No. Page 8 for the North Valencia 2 Annexation was duly noticed and held on October 26, 1999. The City Council public hearing was advertised in an 1/8 page display ad in the Signal on October 5, 1999, through on-site posting 14 days prior to the hearing, and by direct first-class mail to property owners within the North Valencia No. 2 Specific Plan project area and within 500 feet of the project area. Property owners within the adjacent potential North Park Annexation area and within 500 feet of the North Park Annexation also received direct first-class mailing of the public notice. W. The City Council continued the public hearings on the project to November 9, 1999, November 23, 1999 and November 30, 1999. With the exception of the public hearing on November 30, 1999, these hearings were held at or after 7:00 p.m. at the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita. On November 30, 1999, the City Council held a special meeting beginning at 3:00 p.m. in the City Council Chambers, 23920 Valencia Blvd., Santa Clarita for the purpose of taking a site tour of the North Valencia 2 project area. This tour was open to the public. Immediately following the tour the Council closed the public hearing portion of the project and continued this item to the regularly scheduled City Council meeting of January 11, 2000 for the purposes of considering approval documents for this project. X. The City Council has certified the Final Environmental Impact Report (SCH# 98111201) for the project and has adopted a Statement of Overriding Considerations (SOC) for this project by separate resolution. Y. The City Council has amended the Circulation Element to allow a modification to major, secondary and limited secondary highway standard crosssection design, within Specific Plan areas where the following conditions are met: modifications to the standard cross sections are defined in an adopted Specific Plan document; roadway rights-of-way meet or exceed the General Plan Circulation Element rights-of-way for the type of highway; modifications to the standard cross sections will not result in roadway or intersection levels of service (LOS) below those allowable in the General Plan Circulation Element; and modifications to the standard cross sections provide for bikeways, transit improvements and pedestrian connections as identified in the General Plan Circulation Element. The Circulation Element amendment was adopted by separate resolution. SECTION 2. FINDINGS FOR THE PREZONE AND THE SPECIFIC PLAN - Based upon the above findings of fact, oral and written testimony and other evidence received at the public hearings held for the project, and upon studies and investigations made by the Planning Commission and the City Council and on its behalf, the City Council further finds as follows: a. At the hearings described above, the City Council considered staff presentations, agenda reports, Planning Commission staff reports and resolutions, applicant presentations, public testimony on the proposal, and the FEIR, prepared for the project. The Planning Commission recommended that the City Council certify the FEIR, adopt a Statement of Overriding Considerations (SOC) and approve Ord No. Page 9 the related entitlements including the Plan (SP) Zone and adoption of the Document. prezone of the property to the Specific North Valencia No. 2 Specific Plan b. The North Valencia No. 2 Specific Plan Document as modified provides for development standards and types of public and private improvements that will not cause serious public health problems, since access, water, sewage disposal, fire protection, and solid waste disposal are addressed in the MMRP and Conditions of Approval. Modifications to the Specific Plan are hereby incorporated (Exhibit Q. The applicant shall make these modifications to the North Valencia No. 2 Specific Plan Document. C. The project complies with the general requirements and performance standards for the Specific Plan Zone. The North Valencia No. 2 Specific Plan is consistent with the intent of the Specific Plan Zone requirements of the Unified Development Code which was created to: facilitate development of certain areas by permitting greater flexibility and consequently, more creative and imaginative designs; promote more economical and efficient use of land while providing a harmonious variety of choices, higher level of amenities, and preservation of natural and scenic qualities of open space and waterways; and ensure that development substantially conforms to the approved plans. The area included in the Specific Plan Zone was previously prezoned by adoption of Ordinance 99-2 and that ordinance is herein amended to reflect this prezone request as shown on the attached map (Exhibit A). d. A Final Environmental Impact Report (SCH#98111201) has been certified and a Statement of Overriding Considerations (SOC) has been adopted for this project by separate resolution. e. The City Council has adopted an amendment to the Circulation Element of the General Plan to allow for modifications to major, secondary and limited - secondary highway standard cross sections through adoption of a Specific Plan. SECTION 3. PREZONE AND SPECIFIC PLAN DETERMINATIONS- Based upon the foregoing facts and findings, the City Council hereby determines as follows: a. A FEIR (SCH#98111201) has been certified and a Statement of Overriding Considerations (SOC) has been adopted for this project be separate resolution. b. The City Council considered the Planning Commission recommendation on the prezone of this property to the Specific Plan Zone and Specific Plan Document. C. This project as modified by the Planning Commission and City Council will not adversely affect the health, peace, comfort or welfare of persons residing in the area; nor be materially detrimental to the use, enjoyment, or valuation of property in the vicinity of the project site; nor jeopardize, endanger or otherwise 9 Ord No. Page 10 constitute a menace to the public health, safety, or general welfare since the project conforms with the City's General Plan, Unified Development Code and is compatible with surrounding land uses. d. The applicant has substantiated the findings for approval of a Specific Plan and Zone Change to the Specific Plan (SP) Zone. The North Valencia No. 2 Specific Plan Document includes the items required of a Specific Plan by Article 8 -- Specific Plans Sec 65451 of the California Government Code. The SP Zone is an appropriate zone for the site and meets the general requirements and performance standards for a Specific Plan zone identified in Section 17.16.030 of the City's Unified Development Code. SECTION 4. PREZONE AND SPECIFIC PLAN APPROVAIr The City Council hereby approves Prezone 98-003 consisting of a zone change from Los Angeles County Zone C2, Ml V2, and A2-5.to City of Santa Clarita Specific Plan (SP) as shown on the attached prezone map (Exhibit A), amends portions of Ordinance 99-2, and adopts the North Valencia Specific Plan Document (including special development standards) as amended by the Planning Commission and the City Council and herein incorporated by reference (Exhibit B). SECTION 5. This Ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption. SECTION 6.
