A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA
ORDERING THE GRANTING OF PUBLIC SERVICE
FLOOD CONTROL EASEMENTS ALONG SAND CANYON ROAD
IN THE CITY OF SANTA CLARITA TO THE
LOS ANGELES COUNTY FLOOD CONTROL DISTRICT
WHEREAS, the subject public service easements involve the construction of a
storm drain to be constructed by the Los Angeles County Flood Control District financed in part
by the City of Santa Clarita through a Federal Emergency Management Agency (FEMA) grant;
and
WHEREAS, these easements, currently held by the City along Sand Canyon Road,
will be transferred to the Los Angeles County Flood Control District prior to constructing the
storm drain; and
WHEREAS, the description of the easements transferred are described in
Exhibit "A" and shown on the map, Exhibit "B"; and
WHEREAS, the best public interest will be served by transfer of said easements
from the City to the Los Angeles County Flood Control District for construction, as well as
future operation, maintenance, repair, and improvement of said storm drain.
WHEREAS, the City is authorized and empowered to transfer and convey to the
Los Angeles County Flood Control District any storm drain improvements and drainage
systems for future operation, maintenance, repair, and improvements; and
WHEREAS, in light of the tremendous benefit this project will bring to area
residents, the City waives its rights for the demand of compensation for the conveyance by the
Los Angeles County Flood Control District of certain easement rights for this project.
NOW, THEREFORE, BE IT RESOLVED that the City does hereby resolve,
declare, determine, and order as follows:
SECTION 1. That it is hereby found and determined that the easements described
in Exhibit "A" and shown on the map, Exhibit "B," attached hereto and incorporated herein by
this reference, which real property located in the City of Santa Clarita, in the County of
Los Angeles, State of California, are to be transferred to the Los Angeles County Flood Control
District to facilitate the construction, future operation, maintenance, repair, and improvement
of said storm drain.
SECTION 2. That the City Manager or designee executes the "Quitclaim of
Easements" and the "Waiver of Just Compensation."

SECTION 3. That the City Clerk of the City of Santa Clarita be instructed to
forward said documents to the Los Angeles County Flood Control District for recording.
SECTION 4. That the City Clerk shall certify to the adoption of this Resolution.

QUITCLAIM OF EASEMENTS
For a valuable consideration, receipt of which is hereby acknowledged, the CITY OF SANTA CLARITA, a municipal
corporation, successor in interest to the County of Los Angeles by reason of incorporation, does hereby remise, release and
forever quitclaim to the LOS ANGELES COUNTY FLOOD CONTROL DISTRICT, a body corporate and politic, all its right,
title and interest in and to the following easements in, on, over, under and across the real property in the City of Santa Clarita,
County of Los Angeles, State of California, described in Exhibit "A" attached hereto and by this reference made a part hereof.
Easements for flood control purposes acquired by Easement document recorded on September 27, 1937, as Document
No. 612, in Book 15259, page 211, of Official Records, in the office of the Recorder of the County of Los Angeles.
An easement for diversion levee purposes acquired by Agreement recorded May 24, 1938, as Document No. 995, in
Book 15791, page 200, of said Official Records.
Easements for flood control purposes acquired by Easement document recorded on July 14, 1937, as Document No.
693, in Book 15050, page 370, of said Official Records.
An easement for flood control purposes acquired by Easement document recorded on July 21, 1937, as Document No.
778, in Book 15065, page 379, of said Official Records.
IN WITNESS WHEREOF, on 19 , the CITY OF SANTA CLARITA,
a municipal corporation, has caused this Quitclaim of Easements document to be executed by its duly authorized officer pursuant
to a resolution adopted by its City Council.

That portion of the southerly 50 feet of the above-mentioned certain 200 -foot -wide
strip of land, described in easement deed to the County of Los Angeles, recorded on

Official Records.
Containing: 1,578 square feet.

Angeles, described in easement deed to the County of Los Angeles, recorded on
September 27,1937, as Instrument No. 612, in Book 15259, page 211, of Official Records,
in the office of said Recorder.
-- Containing: 9,084 square feet.
PARCEL NO. P-3DL (Easement for diversion levee purposes):
'That portion of that certain 200 -foot -wide strip of land designated as "SOUTHERN
PACIFIC RAILROAD RMP' on the above-mentioned Parcel Map No. 6297, described in
easement deed to the County of Los Angeles, recorded on May 24, 1938, as Instrument
No. 995, in Book 15791, page 200, of the above-mentioned Official Records.
EXCEPTING therefrom that portion lying northeasterly of the generally southwesterly
side line of Sand Canyon Road, as shown on the above-mentioned Parcel Map No. 6297.
ALSO EXCEPTING therefrom any portion lying within the northerly 50 feet of said
certain 200 -foot -wide strip of land.
ALSO EXCEPTING therefrom any portion lying within the southerly 50 feet of said
certain 200 -foot -wide strip of land.

I, the undersigned, do hereby acknowledge that the City of Santa Clarita has been fully
informed of its rights to receive "Just Compensation" forthe easement over property shown
colored on the maps attached hereto and by this reference made a part hereof.
However, the city does waive these rights and agrees to donate said rights to the
Los Angeles County Flood Control District for the above -subject storm drain improvement
project.
This Waiver is signed on behalf of the City of Santa Clarita.
