HomeMy WebLinkAbout2000-01-11 - RESOLUTIONS - GP AMEND NORTH VALENCIA 2 (2)RESOLUTION NO. 00-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING GENERAL PLAN AMENDMENT NO. 98-002A, AN AMENDMENT TO THE LAND USE ELEMENT LAND USE MAP, (MASTER CASE NOS. 98-183, 99-055) FOR THE PURPOSE OF DESIGNATING SPECIFIC PLAN (SP) LAND USE ON 596.2 ACRES LOCATED NORTH OF NEWHALL RANCH ROAD, SOUTH OF COPPER HILL DRIVE, EAST OF SAN FRANCISQUITO CREEK AND COPPER HILL DRIVE, AND WEST OF MCBEAN PARKWAY FOR THE PURPOSE OF ESTABLISHING THE 596.2 -ACRE NORTH VALENCIA NO.2 SPECIFIC PLAN AREA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine as follows: a. On June 25, 1991, the City Council adopted Resolution No. 91-98, adopting the General Plan of the City of Santa Clarita and Certifying the Environmental Impact Report. b. The applicant, the Newhall Land and Farming Company, formally requested certain project entitlements related to creation of a North Valencia No. 2 Specific Plan on August 17, 1998 (Master Case 98-183). Such entitlement requests included an amendment to the General Plan Land Use Map. (GPA 98-002 "A') to designate approximately 596.2 acres to a Specific Plan land use designation for the purpose of creating a North Valencia No. 2 Specific Plan. Over 100 acres of the North Valencia No. 2 Specific Plan area is owned by the Newhall Land and Farming Company._ C. The North Valencia No. 2 Specific Plan area is approximately 596.2 acres generally located north of Newhall Ranch Road, south of Copper Hill Drive, east of the San Francisquito Creek and Copper Hill Drive, and west of McBean Parkway and the existing City boundary, in the unincorporated area of Los Angeles County adjacent to the City of Santa Clarita. The Decoro Drive Bridge area is included in the North Valencia No. 2 Specific Plan area; however, this bridge has been excluded from the proposed 576.2 -acre North Valencia 2 Annexation area at the request of the applicant. The North Valencia No. 2 Specific Plan Area and the North Valencia 2 Annexation area are coterminus with the exception of the 20 -acre Decoro Drive Bridge area and form a contiguous boundary with the City of Santa Clarita. The North Valencia 2 Annexation is an uninhabited annexation. d. The North Valencia No. 2 Specific Plan area contains commercial uses, light industrial uses, and an operational high school, although a majority of the site is vacant. The site p-- is generally flat, although hillside features do occur on portions of the site east of Copper Hill Drive, south of Decoro Drive, as well as the northwest corner of McBean Parkway and Newhall Ranch Road and the south west corner of McBean Parkway and Copper Reso. Page 2 Hill Drive. These hillside features exceed 15% grade but are not shown to have either major or secondary ridgeline status on the City's Ridgeline Map. In the past, portions of the property were previously used for agricultural purposes, and for sludge disposal in conjunction with agricultural uses. Major features of the annexation area include the San Francisquito Creek and a portion of the San Gabriel Fault Alquist-Priolo Special Studies Zone, the Metropolitan Water District easement, and pipeline as well as electrical transmission corridors. Los Angeles County has existing and planned development surrounding this project site. e. The Land Use Element Land Use Map amendment was referred for review to agencies serving the project area as part of the North Valencia No.2 Specific Plan and related entitlements. Referal of the development entitlement applications, including the Land Use Element Land Use Map amendment, was made to various agencies serving Santa Clarita. Among agencies included in development application review were school districts, sanitation districts, transportation agencies serving Santa Clarita, resource agencies serving the project site, LAFCO, Los Angeles County, public water agencies, utility companies, transportation agencies, resource agencies, waste haulers and others. The same public agencies were mailed a Notice of Preparation in accordance with consultation requirements in the CEQtA statutes and guidelines. Additionally, a public scoping meeting on the Notice of Preparation and over 20 public meetings (before the Planning Commission and City Council) were held to provide opportunities for the involvement of citizens, public agencies, public utility companies, and civic, education, and other community groups in this general plan amendment. On June 25, 1991, the City Council adopted Resolution No. 91-98, adopting the General Plan of the City of Santa Clarita and certifying the Environmental Impact Report. The City's General Plan presently designates the annexation areas as Community Commercial (CC), Commercial Neighborhood (CN), Business Park (BP), Residential Estate (RE). Residential Low (RL), Residential Suburban (RS), Residential Medium High (RMH), and Residential High (RH), with a Significant Ecological Area (SEA) Overlay over the San Francisquito Creek, and a Valley Center Concept (VCC) overlay over a portion of sub -area one of the Eastcreek planning area. The General Plan does not specifically mention the North Valencia No. 2 site as an area ideal for a specific plan; however, the site does meet the minimum size of 100 contiguous acres under single ownership as identified in the Specific Plan zoning standards of the City's Unified Development Code. Zoning on the site is presently Los Angeles County zones A-2-5, RPD -5000-8.6U, RPD -5000-5U, RPD -5000-7.8U, RPD -5000-16U, C-3, and MPD and has already been prezoned to City of Santa Clarita zones CC, CN, BP, RE, RL, RS, RMH, and RH. g. The Planning Commission held duly noticed public hearings on the North Valencia 2 Annexation and North Valencia No. 2 Specific Plan and related entitlements including the land use element land use map amendment on March 30, 1999 and continuing on April 6, April 15, April 20, April 29, May 4, May 13, May 18, June 15, June 17, June 29, Reso. Page 3 July 8, July 15, July 20, 1999, August 10, 1999, September 2, 1999, September 9, 1999 and September 16, 1999. The Planning Commission closed the public hearing on September 16, 1999 and continued the item to the meetings of September 21, 1999 and September 28, 1999 for the purposes of finalizing their recommendation to the City Council. On September 28, 1999, the Planning Commission adopted a recommendation that the City Council certify the Final Environmental Impact Report and adopt various entitlements, including an amendment to the Land Use Element Land Use Map to designate a Specific Plan (SP) land use. h. The first City Council public hearing for the North Valencia No. 2 Specific Plan and related entitlements including the amendment to the Land Use Element Land Use Map was duly noticed and held on October 26, 1999. The City Council public hearing was advertised in an 1/8 page display ad in the Signal on October 5, 1999, through on-site posting 14 days prior to the hearing, and by direct first-class mail to property owners within the North Valencia No. 2 Specific Plan project area and within 500 feet of the project area. i. The City Council continued the public hearings on the project to November 9, 1999, November 23, 1999 and November 30, 1999. With the exception of the public hearing on November 30, 1999, these hearings were held at or after 7:00 p.m. at the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita. On November 30, 1999, the City Council held a special meeting beginning at 3:00 p.m. in the City Council Chambers, 23920 Valencia Blvd., Santa Clarita for the purpose of taking a site tour of the North Valencia 2 project area. This tour was open to the public. Immediately following the tour the Council closed the public hearing portion of the project and continued this item to the regularly scheduled City Council meeting of January 11, 2000 for the purposes of considering approval documents for this project. The City Council certified the Final Environmental Impact Report (SCH# 98111201) for the North Valencia No. 2 project including the General Plan Land Use Element amendment request and has adopted a Statement of Overriding Considerations (SOC) for this project in accordance with CEQA by separate resolution. The Environmental Impact Report for this project includes analysis of water supply coordination consistent with California Government Code Planning and Zoning Law Section 65352 and 65352.5. SECTION 2. Based upon the testimony and other evidence received, and upon studies and investigation made by the Planning Commission and by the City Council and on its behalf, the City Council further finds and determines as follows: a. The Specific Plan land use designation is a proper designation for this site because this site includes at least 100 contiguous acres, provides an area for the development of a comprehensively planned community that is superior to development otherwise allowable under alternate regulations (Los Angeles County Code), and allows for future zoning consistent with the Unified Development Code requirements of the Specific Plan Reso. Page 4 zone (Section 17.16.0300). b. The proposed Land Use Element Land Use Map amendment to designate the Specific Plan land use over the North Valencia No.2 project area is consistent with the goals and policies of the General Plan and complies with all other applicable requirements of state law and local law because the Specific Plan land use designation provides for comprehensive planning consistent with the Land Use Element policies, provides for development consistent with City development standards, and encourages coordination of construction of public infrastructure consistent with the Public Services, Facilities, Utilities Element policies. SECTION 3. The City Council has certified the Final Environmental Impact Report (SCH# 98111201) for the project and has adopted a Statement of Overriding Considerations (SOC) for this North Valencia No. 2 project in accordance with CEQA by separate resolution. SECTION 4. Based upon the foregoing, the City Council amends the Land Use Map of the City of Santa Clarita Land Use Element to designate Specific Plan (SP) land use over the North Valencia No 2. Area herein incorporated as Exhibit A. SECTION 5. The City Clerk shall certify the adoption of this Resolution. ^� PASSED, APPROVED AND ADOPTED .Tanuary , 20 -0.
