HomeMy WebLinkAbout2000-05-23 - RESOLUTIONS - GPA NOISE ELEMENT (2)RESOLUTION NO. 00-60 A RESOLUTION OF CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, RECOMMENDING APPROVAL OF GENERAL PLAN AMENDMENT NO. 99-001 (MASTER CASE NO. 99-137) AMENDING THE NOISE ELEMENT OF THE GENERAL PLAN FOR THE CITY OF SANTA CLARITA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby make the following findings of fact: A. On January 9, 1989, the City Council adopted Resolution No. 89-29, approving and certifying the City's Noise ordinance for the Municipal Code for the City of Santa Clarita. B. On June 25, 1991, the City Council adopted Resolution No. 91-88, approving and certifying the Environmental Impact Report for the General Plan and adopting the General Plan for the City of Santa Clarita. C. On February 11, 1992, the City Council adopted General Plan Amendment 91- 001 adding the Noise Contour Map to the General Plan. D. On October 5, 1999, the Planning Commission of the City of Santa Clarita conducted a duly noticed public hearing on proposed General Plan Amendment No. 99-001. This hearing was continued to the Planning Commission meeting of October 19, 1999. The Planning Commission recommended approval of a negative declaration and General Plan Amendment 99-001 by adopting Resolution P99-025. E. On November 9, 1999, the City Council, conducted a duly noticed public hearing on the proposed General Plan Amendment No. 99-002. The public hearing was held on or after 6:30 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita. The City Council continued the public hearing to February 8, 2000. F. On February 1, 2000, the City Council held a study session to discuss the Noise Element Amendment. G. The City Council adopted the Initial Study and Negative Declaration prepared for General Plan Amendment No. 99-001. H. The City Council fully considered the Planning Commission recommendation and all testimony and evidence regarding proposed General Plan Amendment No. 99- 001. I. Proposed General Plan Amendment 99-001 would update the Noise Element Goals, Policies and Exhibits. The proposed changes will be implemented throughout the City of Santa Clarita planning area. Reso. No. 00- 60 Page 2 J. Based on the information provided, the proposed General Plan Amendment 99- 001 would not have an impact upon provisions of affordable housing or open space. SECTION 2. Based upon the testimony and other evidence received, and upon studies and investigations made by the City Council and on its behalf, the City Council finds and determines that the proposed General Plan Noise Element Amendment No. 99-001 and its implementation features are consistent with the goals and policies of the adopted General Plan, and that the proposed amendment and its implementation features comply with all other applicable requirements of state law and local ordinances. SECTION 3. The City Council of the City of Santa Clarita has adopted a negative declaration for this project in compliance with the California Environmental Quality Act (CEQA). SECTION 4. The City Council of the City of Santa Clarita has reviewed and considered the evidence and testimony provided at the public hearing and has reviewed and considered the proposed General Plan Amendment No. 99-001. Based upon the evidence and testimony received and the findings set forth in this Resolution, the City Council hereby takes the following action: A. Approves and adopts the General Plan amendment as set forth in Exhibit A, attached hereto and incorporated herein by this reference. SECTION 5. The City Clerk shall certify the adoption of this Resolution. SECTION 6. This resolution shall be effective immediately upon its adoption. PASSED, APPROVED AND ADOPTED this 23rd day of May 2000.
