HomeMy WebLinkAbout2000-05-23 - RESOLUTIONS - NEGDEC AIR QUALITY GPA (2)RESOLUTION NO. 00- 62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING THE NEGATIVE DECLARATION PREPARED FOR GENERAL PLAN AMENDMENT NO. 99-002 (AIR QUALITY AMENDMENT, MASTER CASE NUMBER 99-190) THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Santa Clarita (hereafter "City") hereby makes the following findings of fact: A. The City of Santa Clarita proposes to update General Plan Amendment 99-002 amending the Air Quality Element Policies to include programmatic updates to be applied to existing and future planning projects. The proposed changes will be implemented throughout the City of Santa Clarita planning area. B. On November 9, 1999, the City Council of the City of Santa Clarita, conducted a duly noticed public hearing on the proposed General Plan Amendment No. 99-002. The public hearing were held on or before 6:30 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita. The Council continued the public hearing to February 8, 2000 at the same place and time. C. This proposal is determined to be a project per the California Environmental Quality Act (CEQA) and has been reviewed pursuant to its provisions. A Negative Declaration has been prepared for the project based on the findings of the Initial Study, dated August 26, 1999, and the determination that the proposed project will not have a significant effect on the environment, will not impact resources protected by the California Department of Fish and Game, and that a finding of de minimus impact on such resources is appropriate. SECTION 2. Based upon the above findings of fact, and upon studies and investigations made on behalf of the City Council, the City Council further finds as follows: A. Based on the Initial Study, the project does not have the potential to adversely effect the environment or resources under the protection of the California Department of Fish and Game, and no significant impacts are anticipated to result from General Plan Amendment 99-002. B. A proposed Negative Declaration was prepared for the project based on the initial Study findings and the determination that the proposed project would not have a significant effect on the environment. C. A notice of environmental assessment was posted and advertised, and the proposed Negative Declaration was made available for at least a 21 -day review period beginning on August 26, 1999 and ending on November 8, 1999 in compliance with the City's adopted CEQA resolution. Reso. No. 00-62 Page 2 SECTION 3. Based upon the foregoing facts and findings, the City Council hereby determines that: A. General Plan Amendment 99-002 is in compliance with the California Environmental Quality Act (CEQA), and state and local CEQA guidelines and with the City's General Plan and Zoning Ordinance. B. The proposed General Plan Amendment will not have a significant effect upon the environment or on resources under the protection of the California Department of Fish and Game. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: A. The City Council hereby approves and adopts the Negative Declaration prepared for the project. B. The City Council hereby directs that a Notice of Determination of Negative Declaration be filed with the County of Los Angeles and the Governor's Office of Planning & Research. SECTION 5. The City Clerk shall certify the adoption of this Resolution. SECTION 6. This resolution shall be effective immediately upon its adoption. Reso.
