A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA,
ESTABLISHING FEES AND CHARGES FOR SITE SPECIFIC
STORM DRAINAGE UTILITY SERVICES, PURSUANT TO TITLE 15, CHAPTER
15.50 OF THE SANTA CLARITA MUNICIPAL CODE, THE REVENUE BOND ACT
OF 1941 AND THE RIGHT TO VOTE ON TAXES ACT;
CANVASSING BALLOTS AND IMPOSING FEES FOR THE
WEST OF MCBEAN BRIDGEPORT DEVELOPMENT
WHEREAS, the City of Santa Clarita (the "City") has evaluated the options
available for funding the maintenance of additional site-specific water quality
facilities associated with the National Pollutant Discharge Elimination System
(NPDES) permit issued to the City by the California Regional Water Quality Control
Board; and
WHEREAS, the evaluation indicated the feasibility and equity of funding the
additional site specific water quality facilities by the formation of a specific storm
drainage utility supported by user charges against all property within the area
served by such facilities would be appropriate; and
WHEREAS, the City Council at its meeting of January 4, 2000, determined
that most water quality facilities established to fulfill the NPDES requirements will
be maintained, operated, improved, or replaced privately, including reliance on
private funding and private maintenance; and
WHEREAS, the City Council, after careful study of said evaluation, did hold
hearings as required by Government Code Section 66018 and, thereafter, enact an
amendment to Title 15, Chapter 15.50 of the Santa Clarita Municipal Code
authorizing the establishment of specific user charges for any water quality facilities
that are site specific; and
WHEREAS, the City intends by the establishment of the fees and charges set
forth herein to fund maintenance of water quality facilities in accordance with the
NPDES requirements of the Federal Clean Water Act, and therefore, the storm
drainage user charge shall herein and henceforth be known as the "Site Specific
Storm Drainage Pollution Abatement Charge"; and
WHEREAS, the City has prepared a report (the "Stormwater Fee Report")
indicating the proposed fees and charges on each parcel in the West of McBean
Bridgeport development; and
WHEREAS, the City Council has examined and considered the Stormwater
Fee Report.

WHEREAS, the charges proposed herein are not discriminatory or excessive
and comply with the provisions of the Revenue Bond Law of 1941 (commencing at
Government Code section 54300 et seq.) and the laws of the State of California; and
WHEREAS, Proposition 218, the Right to Vote on Taxes Act, requires that if
a new fee is imposed on a property, the City shall mail written notice of a protest
hearing to all owners of identified parcels, and that the City shall thereafter conduct
a public hearing at which the City Council shall consider all protests of the proposed
fees and charges; and
WHEREAS, if no majority protest exists, the City shall mail a notice of the
proposed fees and charges together with a ballot to all owners of identified parcels,
and that the City shall thereafter conduct an election and canvass the ballots; and
WHEREAS, the City did conduct said majority protest hearing and election
in conformance with applicable law; and
WHEREAS, a majority protest did not exist at the majority protest hearing
and the ballots in favor or the proposed fees and charges outnumbered the ballots
opposed to the proposed fees and charges; and
WHEREAS, the City complied with all applicable law and the City Council
has now obtained jurisdiction to establish and impose the "Site Specific Storm
Drainage Pollution Abatement Charge"; and
NOW, THEREFORE, THE CITY
CLARITA, STATE OF CALIFORNIA
ORDER AND RESOLVE AS FOLLOWS:
COUNCIL OF THE CITY OF SANTA
DOES HEREBY FIND, DETERMINE,
Section 1. The above recitals are true and correct.
Section 2. The City Council is satisfied with the correctness of the
Stormwater Fee Report, a copy of which is attached hereto as Exhibit "A" and
incorporated herein by this reference and is available in the City Clerk's Office, and
with the proceedings and all matters relating thereto.
Section 3. The fees and charges set forth in the Stormwater Fee Report are
hereby adopted and imposed. The Site Specific Storm Drainage Pollution
Abatement Fee will include an annual inflation adjustment in accordance with the
Consumer Price Index (CPI) for Los Angeles, Long Beach, and Anaheim, for April of
each year.
Section 4. The City Clerk shall certify to the adoption of this Resolution.

STORMWATER FEE REPORT
The sediment clean-out cycle for a basin in a stabilized watershed is typically on the
order of ten to twenty years; however, the cost of sediment removal at each cycle can
be up to 40% of the initial pond construction cost, depending on the size and
accessibility of the pond and the methods used to remove, transport and dispose of
accumulated sediment. Therefore, budgeting for more frequent removal, on the
order of every five to ten years, is recommended.
The following annual budget for maintenance includes monthly inspection,
landscaping and debris removal as well as annualized reserve funds for erosion
control, sediment removal and revegetation and for hazardous material removal (if
required).
The Site Specific Storm Drainage Pollution Abatement Fee will include an annual

WAIVER
OF CERTAIN PROCEDURES RELATING TO IMPLEMENTATION OF FEES AND
CHARGES FOR THE CITY OF SANTA CLARITXS SITE SPECIFIC STORM
DRAINAGE UTILITY SERVICES

Honorable Mayor and Councilmembers:
The undersigned are the sole owners of the real property described on Exhibit A (the
"Property"), attached hereto and incorporated herein by this reference, located
within the area recently annexed to the City of Santa Clarita (the "City"), and we
hereby agree as follows:
1. We acknowledge and understand that pursuant to California Constitution
Article XIIIC, Section 6, we have a right to the following:
a. We have the right to 45 days prior written notice of a public hearing to
be held by the City Council to consider the imposition of a proposed
increase in stormwater drainage service fees, such notice to include:
1. The amount of the proposed additional stormwater drainage
services fee to be imposed upon each parcel of land;
2. The basis upon which the amount of the proposed additional
fee was calculated;
3. The reason for the additional fee; and
4. The date, time and location of the public hearing on the
proposed additional fee.
b. We have the right to submit at the public hearing protests against the
proposed Site Specific Storm Drainage Pollution Abatement Fee.
C. We have the right to vote in an election on the imposition of the
proposed Site Specific Storm Drainage Pollution Abatement Fee to be
held not sooner than 45 days after the public hearing.
2. It being our intention that the City proceed as quickly as possible with the
imposition of the Site Specific Storm Drainage Pollution Abatement Fee, we
waive all otherwise applicable times for the conduct by you of the public
hearing and the election to order the levy of the additional stormwater
drainage services fee.
3. In furtherance of said waiver, we agree that said public hearing and election
proceedings may be consolidated and that said election may be conducted by
mailed or hand -delivered ballot to be returned as quickly as possible to the
office of the City Clerk of the City of Santa Clarita and that the results of
said election be canvassed and reported to you as soon as possible.
