A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA
VACATING A PUBLIC SERVICE EASEMENT (SEWER),
TRACT NO. 51931, GREYSTONE HOMES,
IN THE CITY OF SANTA CLARITA
WHEREAS, the sewer easement within Tract No. 51931, adjacent to Avenue Scott,
has been superseded by relocation, and the developer requests that the easement be
vacated; and
WHEREAS, the proposed vacation was reviewed and a notice of exemption for the
vacation of the public service easement in compliance with the California Environmental
Quality Act, was certified, and such notice was filed with the County Clerk of the County of
Los Angeles; and
WHEREAS, under Chapter 4, Summary Vacation, of Part 3 of Division 9 of the
Streets and Highways Code of the State of California, no public hearing is required and no
public hearing was held.
THEREFORE, pursuant to the provisions of Section 8334 of Part 3 of Division 9 of
the Streets and Highways Code of the State of California, the City Council of the City of
Santa Clarita, California, does resolve, declare, determine, and order as follows:
SECTION 1. That it is hereby found and determined that the sewer easement, as
described on Exhibit "A" and shown on Exhibits "B" and "C" attached hereto and
incorporated herein by this reference, which real property located in the City of Santa
Clarita, County of Los Angeles, State of California, is no longer needed for present or
prospective use based on the fact that this easement is superseded by relocation.
SECTION 2. That within the sewer easement to be vacated, no public utility
facilities exist that would be affected by the vacation.
SECTION 3. That City staff of the City of Santa Clarita be instructed to record a
copy of the certified original resolution in the office of the Registrar -Recorder of the
County of Los Angeles, at which time the sewer easement vacated will no longer be a public
service easement.
