DEPARTMENT: Administrative Services - City Manager Approve the application of Proposition 13 funds from the Regional Water Quality Control Board and authorize the City Manager or Designee to execute all documents, subject to City Attorney Approval and pending the receipt grant funds. The amount of the grant will not exceed $200,000. The City is currently seeking to acquire and conserve a portion of Bouquet Canyon Creek adjacent to the southwestern boarder of Central Park, south of the New Wine Christian Center, and between the bridge on Bouquet Canyon Road near Alamagordo Road and the housing development off Festividad and Paraguay through a competitive grant process with the Regional Water Quality Control Board. In November 2000, the Regional Water Quality Control Board issued a request for proposals from various public and private entities to receive funds for various projects outlined in Proposition 13, The Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Bond Act. A total of $8.4 million has been made available during this cycle. The City has identified the last remaining unchannelized section of Bouquet Creek as a project site. The creek contains a variety of native plant and animal species and is a potential habitat for a variety of federally endangered species. The proposed project consists of three elements: • The acquisition of approximately 3.1 acres of property directly south of the New Wine Christian Center, including the banks and bottom of Bouquet Creek. The property is, currently owned by the American Baptist Churches of the Pacific Southwest. Staff is currently negotiating to obtain a letter of intent to sell from this organization. It is anticipated that they will be a willing seller. Agenda Item it3 a� tib li L✓ APPLICATION FOR PROPOSITION 13 FUNDS January 23, 2001 Page 2 of 2 • Once acquired, the property will be held as open space and its existing riparian habitat will be preserved. • The southern bank, adjacent to Central Park, will include a small passive recreation area and interpretive display to highlight the natural beauty of the habitat. In addition, Staff is working closely with a variety of community groups to gamer support for implementing the project. The grant budget will cover acquisition of the property, a phase I environmental report, the conservation plan, design and engineering of the proposed passive recreation element, and the construction of the passive recreation element. The total grant amount will be known upon the receipt of an appraisal report due to the City on January 23, 20001. The grant will require a cash match of between 10% and 16% of the capital cost of the grant request (depending on the actual grant amount). The total match required will not exceed $30,000. ALTERNATIVE ACTION Other action as determined by Council. FISCAL IMPACT If successful, the grant would require a local match not to exceed $30,000. These funds are not currently in the budget, and would be requested either from City Council contingency or Fund Balance. In addition, approximately $6,000 will be needed in annual maintenance costs. The grant request will provide funding for the first year of maintenance. The annual maintenance expenditures thereafter will be addressed through the City's normal budget process.
