CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented Ruben Barrera PUBLIC HEARING DATE: February 13, 2001 SUBJECT: INCREASE IN THE DEVELOPER FEES FOR FIRE PROTECTION FACILITIES IN ACCORDANCE WITH THE JOINT COLLECTION AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY DEPARTMENT: Planning and Building Services RECOMMENDED ACTION Conduct public hearing, receive testimony and adopt a Resolution. BACKGROUND The The County is proposing to increase the Developer Fee for the benefit of the Consolidation Fire Protection District by 1%, from $.1976 per square foot to $.1997 per square foot of construction. The County of Los Angeles Fire Department annually updates its Consolidated Fire protection District Developer Fee Program. This includes the adoption of the updated Detailed Fire Station Plan (Capital Improvement Plan). The program and plan began in 1992 with the approval of a joint agreement between the City and the County. The fee is imposed on building permits. It has been adjusted annually, (sometimes decreased) as the needs change for fire facilities. In accordance with the above agreement, it is appropriate for the City to increase the fee accordingly. ALTERNATIVE ACTIONS There are no alternative actions as identified by staff. The agreement requires the City's Participation. IT IS RECOMMENDED THAT YOUR BOARD, ACTING AS THE GOVERNING BODY OF THE CONSOLIDATED FIRE PROTECTION DISTRICT: At the conclusion of the public hearing to update the developer fee detailed fire station plan and increase the developer fee for 2000-01 to $.1997 per square foot from the 1999-00 fee of $.1976 to reflect current average costs associated with land acquisition, fire station construction, apparatus, equipment and administrative costs associated with fee collection and project and facilities management: (a) find that the project is exempt from the California Environmental Quality Act (CEQA) in that it approves fees for capital projects necessary to maintain services within existing service areas (CEQA Guidelines Section 15273(a) (4); (b) find that the project will have no adverse effect on wildlife resources and authorize the Consolidated Fire Protection District to complete and file a Certificate of Fee Exemption for the project with the County Clerk; and (c) adopt the attached resolution to update the Developer Fee Program (Attachment A). The Developer Fee Program was implemented August 1, 19903 to fund the acquisition, construction, improvement, and equipping of fire station facilities in the high -growl urban -expansion areas of the District. Two components of the Developer Fee Program, the Developer Fee Detailed Fire Station Plan (capital facilities plan) and the fee amount, are updated annually upon conclusion of a public hearing. JUSTIFICATION: Pursuant to Government Code Section 66000, et. seq., the District has updated the capital facilities plan to reflect fire station requirements based upon the most current growth projections in the areas of li benefit. In the next five years it is anticipated that 23 additional fire stations, one temporary facility, and the expansion bf two existing fire stations will be needed within the areas of benefit at a total estimated cost of $62,763,791. The need for the 23 new facilities, a temporary facility, and the expansion of two ,existing facilities is directly related to development in the areas of benefit. The developer fee amount has been updated for Fiscal Year 2000-01 to $.1997 per square foot, an increase from the 1999-00 Fiscal Year fee of $.1976. The updated fee reflects current average costs of land acquisition for a fire station site, fire station construction, apparatus, equipment, and administrative Costs associated with fee collection and project and facilities management. The Auditor -Controller has reviewed the updated fee amount and found it reasonable. ( Attachment B). A summary of the fee calculation is attached The Honorable Board of Supervisors June 8, 2000• Page 3 FISCAL IMPACT The Developer Fee Program provides a revenue source from which to fund essential fire station facilities and equipment in the areas of urban growth. During the period of July 1, 1999 developer fee collections in the three areas of benefit were as follows: to April 30, 2000, Area 1, Malibu/Santa Monica Mountains Area 2, Santa Clarita Valley $ 123,997 $1 Area 3, Antelope Valley ,121,301 387,552 Total Developer Fee Collections July 1, 1999 — April 30, 2000 $1,632,850 A final report detailing the total revenue collected and expended in Fiscal year 1999-00 will be submitted for review by your Board subsequent to the close of the Fiscal year, pursuant to Government Code requirements. FINANCING The developer fee update requires no funding to implement. Pursuant to Government Code Sections 66002 and 66018, notice of the public hearing to update the capital facilities plan and the developer fee amount must be published in a newspaper of general circulation in the three areas of benefit. The developer fee is exempt from the provisions of Proposition 218. County Counsel has approved as to form the attached resolution updating the capital facilities plan and developer fee amount The Honorable Board of Supervisors June 8, 2000• Page 4 CONTRACTING PROCESS: Not applicable. The updated fee amount of $.1997 will be imposed in the unincorporated areas in the three developer fee areas of benefit effective August 1, 2000. The updated developer fee amount will be imposed in the cities of Calabasas, Malibu, Santa Clarity Lancaster, and Agoura Hills upon adoption by the cities of a resolution updating the fee amount. This project is statutorily exempt per Section 15273(a) 4 of the CaliforniaEnvironmental Quality Act guidelines developed by the State Office of PlanningResearch. A Notice of Exemption is attached. CONCLUSION: Upon conclusion of the public hearing, please instruct the Executive Officer of the Board to return two (2) copies of this letter with the adopted Resolution to the Consolidated Fire Protection District. NOW, THEREFORE, the Board of Supervisors resolves, finds, and determines that: 1• The Developer Fee Program is for the purpose of obtaining funds for capital projects necessary to maintain service within the existing seryice areas of the Consolidated Fire Protection District of Los Angeles County, and as such is statutorily exempt per Section 15273(a)(4) of the California Environmental Quality Act guidelines developed by the State Office of Planning and Research. 2• On July 25 , 2000, a public hearing was held to update the Developer Fee Program and to consider 1) the updated Developer Fee Detailed Fire Station Plan dated June 2000 (Fire Station Plan) attached hereto and incorporated herein, which serves as the capital improvement plan and describes the acquisition, construction, installation, and equippingof fire stations; and 2) the updated developer fee amount to be levied among the parcels within the areas of benefit. 3. It is determined that there are reasonable relationships between: 1) the developer fee's use and the type of development projects on which the developer fee is imposed, 2) the need for the fire station facilities and the type of development project on which the developer fee is imposed, and 3) the amount of the developer fee and the cost of the fire station facilities, or a portion of the fire station facilities attributable to the development on which the developer fee is imposed. -2- 4• The Board of Supervisors approves and adopts the updated Los Angeles County Developer Fee program for the benefit of the Consolidated Fire Protection District of Los Angeles County as follows: a) the updated developer fee amount will be $,1997 per square foot of the new floor areas of buildings effective August 1, 2000; b) the updated Fire Station Plan is approved and adopted; and c) all other terms and provisions of the Developer Fee Program as adopted by resolution of the Board of Supervisors of the County of Los Angeles shall remain unchanged and in full force and effect.
