HomeMy WebLinkAbout2001-11-27 - AGENDA REPORTS - DIAPER RECYCLING (2)CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by:AFossellman DATE: November 27, 2001 SUBJECT: DIAPER RECYCLING PILOT PROGRAM LETTER OF AGREEMENT DEPARTMENT: PLANNING AND BUILDING SERVICES RECOMMENDED ACTION City Council approve the Letter of Agreement between the City, Knowaste, LLC and Browning Ferris Industries for the processing location of the Knowaste Diaper Processor II for the diaper recycling pilot, subject to City Attorney review. BACKGROUND At the June 12, 2001 City Council meeting, the Council approved the diaper -recycling pilot program Memorandum of Understanding (MOU). On July 10, 2001 the Council approved the diaper -recycling processor contract. Both documents outline the responsibilities of the City, haulers, and Knowaste, LLC (Knowaste) in the diaper -recycling pilot program and require that Knowaste locate and secure a location to house the Knowaste Diaper Processor II (KDP II) throughout the duration of the pilot program. According to the MOU, Knowaste is required identify a mutually agreed-upon location for the diaper processor that is within a 25 -mile driving radius of City Hall. On October 24, 2001 Knowaste informed the City of their intention to use the BFI Facility located at 9200 Glenoaks Boulevard in Sun Valley for the processing location, which is located approximately 21 miles from City Hall, and presented the City with a draft Letter of Agreement (LOA). Upon notification of the proposed location, City staff visited the site to evaluate the site's potential for housing the KDP II processor. The location is an administrative and maintenance facility for BFI and is not currently permitted for materials recovery and recycling operations. Staff is working with James Aidukas, Project Consultant of JTA and Associates, BFI's environmental permitting consultant for the project, to develop the strategy to obtain all necessary permits and clearances prior to delivery and installation of the processor at the BFI Facility. The scope of the LOA prescribes that the processor will not be delivered to the BFI Facility until all environmental permits and clearances have been obtained. 1 »'r�9 ��Sn f F Agenda Item: Highlights from the scope of work includes: Facility • Provision of an area large enough at the BFI Facility (9200 Glenoaks Blvd., Sun Valley California) to accommodate the diaper processor, processing activities (including adequate room for drop-off of materials) and secured storage recyclables (to protect against weather and theft) • Construction of an overhead structure adequate to protect the diaper processor from the elements • Security of the facility to prevent trespassing, vandalism and theft during times of operation and non -operation Identification of the weigh location, or scale, (must be within 1 mile of the processing location, with the City's preference being immediately adjacent to the processing location) • Knowaste will be responsible for paying and training all workers necessary to operate the KDP II Machine • Knowaste and BFI shall be responsible for delivery of recyclables to a recycling center and collection and tracking or revenue received for the sale of the recyclables (if the amount collected is sufficient for sale) • The City has the right to inspect the processor and surrounding areas related to the function of the pilot at any time during normal operating hours of BFI's Sun Valley Facility Permitting and Environmental Clearance Obtain all required permits, environmental clearances, and governing agency approvals, including but not limited to sewer, utility, and operation, prior to the delivery and operation of the diaper processor Records and Reporting • Collection of data and maintenance of a database in a spreadsheet format throughout the duration of the pilot program (City is to design and provide the database format) • Data must be collected and provided to the City on a monthly basis for the following areas: • Weight per truck tipping (each record must have the weight, date tipping, hauler, route) • Weight of recycled fiber pulp collected per month • Weight of recycled plastic collected per month • Weight of the residual disposal materials (that must be land filled) • Price obtained for the sale of recyclables by type of recyclables • Total revenue per month for the sale of recyclables by the type of recyclables Weigh tickets/receipts generated per truck (paper tickets must be collected and provided to the City on a monthly basis with the monthly summary report) Pursuant to Council direction on July 10 when the contract to purchase the KDP II was approved, the City will not expend any additional funding on this project. All costs associated with preparation of the site, installation of the processor, operating and training expenditures, environmental permits and clearances, and the sewer connection are the responsibility of Knowaste and BFI. Upon the conclusion of the pilot, BFI has agreed to continue to store the KDP II at their location for an additional 6 months, or longer if mutually agreed to by the City and BFI. ALTERNATIVE ACTIONS Other action as determined by the Council. FISCAL IMPACT Funds in the amount of $500,000 are currently budgeted for startup and acquisition of the diaper processor ($250,000 in 3811-8021 and $250,000 in 3815-8021). The first payment for the processor in the amount of $200,000 will be due to Knowaste upon execution of the Letter of Agreement. ATTACHMENTS Letter of Agreement between the City, Knowaste, and BFI.
