SUBJECT: AWARD CONTRACT FOR PURCHASE OF ONE DUMP TRUCK
DEPARTMENT: Administrative Services
RECOMMENDED ACTION
City Council allow the low bidder, Big T's Freightliner, to withdraw their bid, find the
second low bid from Thorson Motor Center non-responsive, and award a contract for one
medium -duty dump truck to Western Truck Exchange, in the amount of $60,847.20, as
specified in bid number PS -00-01-26, from account number 5230-8615.
BACKGROUND
The City Council approved funds in FY 00/01 for the purchase of a new medium -duty dump
truck. A notice inviting bids was sent to Bidnet, Chamber of Commerce, Valencia
Industrial Association, and advertised in the local newspapers. Bid packages were
delivered to 17 dealers who responded to the notice. A total of 6 responses were received.
On April 23, 2001, the sealed bids were opened and read by the City Clerk, and the results
of the bids with selected alternatives are shown below:

All of the bids contained some exceptions to the specifications. Subsequent to the bid
opening, Big Ts Freightliner submitted a written request to increase their bid price or
withdraw their bid due to a clerical error. Staff recommends the low bid be withdrawn.
The remaining five bids were evaluated. The bid from Thorson Motor Center contained an
exception to the specifications, which was the refusal to accept the liquidated damages

clause for late delivery. The review of the third low bid, from Western Truck Exchange,
found the exceptions to be minor, not affecting the truck's function. Staff finds their bid to
be the lowest responsive, responsible bid and recommends they be awarded the contract.
ALTERNATIVE ACTION
1. Reject all bids and rebid.
2. Other action as determined by the City Council.
FISCAL IMPACT
FY 00/01 funds for this expenditure are budgeted in account number 5230-8615.
