BACKGROUND The Federal Clean Water Act sets forth specific requirements with which the City must comply on an annual basis. These requirements are provided in the National Pollution Discharge Elimination System (NPDES) Permit issued by the California Regional Water Quality Control Board. In order to fund the services needed to be in compliance with this federally mandated program, the City adopted Ordinance No. 94-7, enacting Chapter 15.50 of the Santa Clarita Municipal Code (SCMC), Storm Drainage Utility Enterprise Fund including the Storm Drainage Pollution Abatement Charge. This charge was originally enacted in 1994. However, in compliance with the Government Code it is reaffirmed each year. For fiscal year 2001-2002, the fee will remain unchanged at $21 per equivalent dwelling unit. This fee is based on the cost of providing the services required under the NPDES permit, which is estimated at $2,170,000 per year. Government Code Section 54354.5 states that the specific fees to be charged for services must be adopted by City Council Resolution, after providing notice and holding a public hearing. The City has provided notice and will receive testimony at this public hearing. ATTACHMENT Resolution TL S:IPBSIENVSAVCSICOUNCMWPDES\CCNPDES612.DOC CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING TO CONSIDER A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA ESTABLISHING FEES AND CHARGES FOR STORM DRAINAGE UTILITY SERVICES IN THE CITY OF SANTA CLARITA, CALIFORNIA PUBLIC NOTICE IS HEREBY GIVEN: A Public Hearing will be held before the City Council of the City of Santa Clarita to consider a resolution of the City Council of the City of Santa Clarita establishing fees and charges for storm drainage utility services in the City of Santa Clarita, California. The hearing will be held in the City Hall Council Chambers, 23920 Valencia Blvd., 1'° Floor, on the 12`h day of June 2001, at or after 6:00 p.m. Proponents, opponents, and any interested persons, including all persons owning property in the local agency, may appear and be heard as to whether the proposed raters and charges are discriminatory or excessive, or will not be sufficient under Section 54515, or will not comply with any other provision of this chapter, or will not be sufficient under the provisions or covenants of any outstanding revenue bonds of the local agency payable from the revenues of the enterprise, or on any other matter relating to said proposed resolution or ordinance or the rates or charges proposed therein.
