T1007 AND FTA PROJECT NOS. CA -90-X936 AND CA-90-YO68 - REJECTION OF ALL BIDS AND AUTHORIZATION TO RE -ADVERTISE FOR BIDS; AND APPROVE LOT LINE ADJUSTMENT NO. 01-005 AND RIGHT-OF-WAY AGREEMENTS DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION 1. City Council authorize rejection of all construction contract bids for the construction of the McBean Transfer Station, Project No. T1007 and FTA Project Nos. CA -90-X936 and CA -90-Y068, and direct staff to re -advertise for bids. 2. City Council approve the lot line adjustment and the associated quitclaim deeds, and accept the Grant Deed offered by the Newhall Land and Farming Company; and authorize the City Manager to sign all necessary documents, subject to City Attorney approval. 3. City Council approve the right-of-way agreement and the associated quitclaim deed with The Gas Company; and authorize the City Manager to sign all necessary documents, subject to City Attorney approval. BACKGROUND The McBean Transfer Station is centrally located within the Santa Clarita Transit service area on Valencia Boulevard west of McBean Parkway, adjacent to "The Greens" development. This project will provide for bus -to -bus transfers for patrons using the Santa Clarita Transit system. Given its location, the Transfer Station will allow for the restructuring of bus routes, resulting in a daily reduction of 324 bus miles (96,348 annually), thereby reducing travel time by an average of 15 minutes for many cross-town trips presently requiring transfers. Upon completion of the Transfer Station, the temporary transfer post on Citrus Drive will be removed. PROVED Agenda Item: 441 MCBEAN TRANSFER STATION, PROJECT NO. T1007 May 8,2001 - Page 2 The scope of work for the McBean Transfer Station project is to construct a pedestrian island with bays to service 12 buses. Additional features will include passenger amenities, such as restroom facilities, canopies for pedestrian protection from the elements, and a clock tower. The facility will be interconnected with local pedestrian access to both Valencia Boulevard and McBean Parkway. On September 12, 2000, the City Council approved the plans and specifications and authorized the advertisement for construction bids. On March 29, 2001, the California Transportation Commission (CTC) allocated an additional $1,035,000.00 of federal grant funds to complete the funding requirements for the construction of this project. On April 10, 2001, the City Clerk's office received bids for the project (see Exhibit "A"). The architect's estimate for the construction of this project is $2,425,636.00. On April 13, 2001, the City received a letter of bid withdrawal (see Exhibit "B") from Doug DenBoer, General Manager with the apparent low bidder, DenBoer Construction. The letter stated that several clerical errors were made by estimating staff on the part of DenBoer Construction on bid Item No. 47, as well as the price from DenBoer Construction's electrical subcontractor, R.W. Gray Electric, Inc. Due to the above referenced errors, the overall contract price will change substantially. After review of the associated bid documents and letter from DenBoer Construction, staff and the City Attorney agreed that the bidder's withdrawal should be accepted. Therefore, the City would not hold the forfeiture of the bid bond. Also, after review of the associated bid documents and references of the second and third lowest bidder, FedCon General Construction and Terra -Cal Construction, respectively, staff concluded that additional major and minor irregularities were found. Therefore, staff recommends rejection of all bids and authorization to re -advertise all bids. This will allow staff to evaluate certain bid items to come up with alternative solutions on materials to generate savings to the construction costs. As directed by the City Council, staff will authorize The Gas Company to relocate the 22 -inch high-pressure pipeline from the project site. The Gas Company will start the relocation of the 22 -inch high-pressure pipeline this month and be completed prior to the start of City construction. The completion of the McBean Transfer Station will take approximately six months. The pipeline on the project site will be abandoned in place, and a new pipeline placed along Valencia Boulevard and on private property just west of the project site. To accommodate the new gas pipeline, The Gas Company has requested a 10 -foot easement along the west boundary limits of the project site for access to the pipeline located on the adjacent private property, and a 20 -foot wide easement with "prior rights" within Valencia Boulevard right-of-way. The approval of the agreements (available in the City Clerk's reading file) will allow for the proper legal recordation of easements along the new pipeline, and the quitclaim of the existing 10 -foot wide Gas Company easement traversing the project site. T1007 May 8, 2001 - Page 3 During the design of the facility, the City's consultants discovered that "The Greens" golf putting facility had been constructed across the property line of the land purchased by the City. While working with the Newhall Land and Farming Company to facilitate the completion of design and connection to existing utilities, a tentative agreement was reached to resolve the construction error. The Newhall Land and Farming Company agreed to prepare all documentation necessary to adjust the lot lines, to bring the golf facility into compliance, and grant more property than was taken to replace it. The end result is that the City will have approximately 7,300 square feet more than originally purchased, allowing for a better designed facility. The approval of the deeds (available in the City Clerk's reading file) will allow for the proper legal transfer of the property and adjustment of the lines. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT 1. In addition to funds previously appropriated by the City Council, the California Transportation Commission (CTC) allocated an additional $1,035,000.00 of federal grant funding toward this project on March 29, 2001. With regard to the lot line adjustment, the net additional property will be granted to the City at no cost. On item number 47 - Structural Steel 6 Architecturally Exposed Structural Steel, the cost inserted on our Estimating Worksheet for the shade structures was actually thecostfor only one shade structure and not for six as required. The amount was not multiplied by six as the estimator intended to do once the coat per structure was determined. This would have made the price for this item $663,369.00 instead of $165,200.00, an error of $498,169.00. In addition to this error, our listed electrical subcontractor, R. W. Gray Electric, Inc., had submitted a bid totaling $224,103.00. This number was based on his guess of what the fixture prices would be and he had been unable to get an actual price from his supplier. Soon after the bid was submitted he received a price from his supplier that caused his price to increase to $331,103 a difference of $107,000.00. We received his revised price approximately 10 minutes past 11:00. Due to the above errors, our bid price was $605,169.00 too low requesting to withdraw our bid due to a clerical error.
