SUBJECT: CERTIFICATE OF CONFIDENTIALITY SALES AND USE
TAX CONSULTANTS
DEPARTMENT: Administrative Services
City Council adopt a Resolution, authorizing HdL Companies to examine sales and
use tax records of the California State Board of Equalization, provided to the City,
pursuant to the City contract under the Bradley -Burns Uniform Sales and Use Tax
Law.
The City contracted with HdL Companies to provide sales and use tax data tracking
and analysis for the City.
As a procedural matter, in order to provide sales and use tax services for the City, it
is necessary that the City Council authorize the consultant to review the City's sales
and use tax information from the California Board of Equalization (B.O.E). This can
be accomplished by resolution of the legislative body, as specified in section
7066(bXI) of the State of California Revenue and Taxation Code.
Council's action allows HdL Companies access to information that is otherwise
considered confidential by the B.O.E. This new firm will replace the sales and use
tax firm that the City has contracted with previously. HdL will be performing a
similar analysis.
City Council not adopt a Resolution, authorizing consultant to examine sales and
use tax records from the B.O.E.

Each year funds are budgeted for sales and use tax consultants to analyze the City's
data. Through audits, sales and use tax consultants recover misallocation and
other errors from the State Board of Equalization, resulting in new revenue to the
City. The Consultants are compensated at a rate of 16% of all new sales and use tax
generated as a result of audit and recovery work performed. The actual amount will
vary from year to year.
