TRACT MAP NO. 45416 (SIERRA HEIGHTS) — APPROVAL OF
FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION

RECOMMENDED ACTION
1) City Council approve Tract Map No. 45416 (Sierra Heights);
2) Accept on behalf of the public the offers of dedication for public streets, of future streets
(Sierra Highway), the right to restrict direct vehicular ingress and egress to
Sierra Highway, all sanitary sewers and appurtenant structures within the tract,
easements for covered storm drains, ingress and egress and flood control purposes,
easements for sidewalk purposes, easements for sanitary sewer purposes, easements for
sight distance purposes, the right to restrict the erection of buildings and other
structures within the flood hazard areas, and the right to restrict the erections of
buildings within Lot Nos. 178, 179, 180, 181, 182, 183, 184, and 185, open space lots;
3) Make findings as follows: (a) that this project is consistent with the provisions of
Sections 66474 and 66474.1 of the Subdivision Map Act and should be approved, and
(b) that this proposed subdivision, together with the provisions for this design and
improvement, is consistent with the General Plan required by Article 5 (commencing
with Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific
plan adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of
Division 1 of the Government Code;
4) Instruct the City Treasurer to endorse the Special Assessment Certificate on the face of
the map for Tract Map No. 45416, which indicates that all special assessments levied by
the City have been paid; and
5) Instruct the City Clerk to endorse the Certificate on the face of Tract Map No. 45416,
which embodies the approval of said map and the acceptance of the dedications shown
thereon.
BACKGROUND
Tract Map No. 45416 (Sierra Heights) is the only phase of Vesting Tentative Tract Map No.
45416, which was granted approval by the Planning Commission on June 18, 1991, and the
City Council on October 8, 1991. A Development Agreement that allows for phasing was

approved on November 1, 1991. This only phase, consisting of approximately 99.2 acres, is
located east of Scherzinger Lane and south of Sierra Highway, and is owned by the
Pardee Construction Company.
Water rights have been secured for all 185 lots (177 residential lots and 8 open space lots).
Sufficient street and future street right-of-way is being dedicated along Sierra Highway for
a future bike path.
The Quimby obligation has been satisfied with the payment of a $271,685.00 park in -lieu
fee, as required by the conditions of approval.
The conditions set by the Planning Commission have been met, and fees have been paid as
indicated on the attached Fact Sheet. The map has been checked to the satisfaction of the
City Engineer and is ready for City Council approval and acceptance of the dedications.
ALTERNATIVE ACTION
Staff has not identified any alternative actions that would conform to requirements set
forth in the Subdivision Map Act.
FISCAL IMPACT
The public streets shown on this map will be dedicated to the City. The maintenance of
these streets will impact the City's street maintenance budget.
The developer is contributing the following amounts for the purposes described (refer to the
attached Fact Sheet for details):
Bridge and Thoroughfare Fees: $1,487,938.00* (see Fact Sheet)
Transit Mitigation Fee: $35,400.00
Quimby Requirement: $271,685.00
*Subject to an increase annually in accordance with the Consumer Price Index in
accordance with the approved Development Agreement.

The project is located in the East Side Bridge & Thoroughfare
District. The B&T obligation, based on 177 single-family units for
this phase, is $1,487,938.00. Per the Development Agreement,
these fees will be paid at issuance of building permits.
The developer, based on a maximum of 177 units for this phase,
has paid a Transit Mitigation Fee of $35,400.00.
Seven new public streets are being proposed within this phase.
To be paid at building permit stage per agreement with the school
districts.
