Nay DATE: October 23, 2001 SUBJECT: APPROVAL OF THE ANNEXATION OF TERRITORIES AND THE LEVY OF ASSESSMENTS FOR SANTA CLARITA STREETLIGHT MAINTENANCE DISTRICT NO. 1: • ANNEXATION NO. 2001-1,21,23551 MAGIC MOUNTAIN PARKWAY • ANNEXATION NO. 2001-L22, TRACT NO. 53114 IN THE VICINITY OF DOCKWEILER DRIVE AND VALLE DEL ORO • ANNEXATION NO. 2001-L23,18525 VIA PRINCESSA DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council conduct a public hearing and adopt a resolution to approve the annexation of territories and the levy of assessments for Santa Clarita Streetlight Maintenance District No. 1 as Annexation Nos. 2001-L21, 2001-L22, and 2001-L23. BACKGROUND As a condition of the approval: Assessor Parcel Nos. 2811-025-072 through -077, located in the vicinity of 23551 Magic Mountain Parkway, streetlight improvements are required. Terry York Motor Cars, Ltd., a California Limited Partnership, hereinafter referred to as the "Developer," has agreed to install or provide funds for all necessary on-site streetlight improvements as required as a condition of the approval of the aforementioned parcels. The Developer has signed a petition requesting the annexation of this streetlight maintenance into Santa Clarita Streetlight Maintenance District No. 1 as Annexation No. 2001-L21. For Tract No. 53114, located in the vicinity of Dockweiler Drive and Valle del Oro, streetlight improvements are required. E -Z Access Self -Storage, LLC, hereinafter referred to as the "Developer," has agreed to install or provide funds for all necessary on-site streetlight improvements as required as a condition of the approval of the aforementioned parcel. The Developer has signed a petition requesting the annexation of this streetlight maintenance into Santa Clarita Streetlight Maintenance District No. 1 as Annexation No. 2001-L22. Adopted:�c=1-134 7-i3S of -130 Agenda Item: STREETLIGHT MAINTENANCE DISTRICT NO. 1 ANNEXATION NO. 2001-L21, L22, AND L23 October 23, 2001— Page 2 Assessor Parcel Nos. 2842-026-034 and 2842-026-035, located in the vicinity of 18525 Via Princessa, streetlight improvements are required. Jack In The Box Restaurant, hereinafter referred to as the "Developer," has agreed to install or provide funds for all the necessary on-site streetlight improvements as required as a condition of the approval of the aforementioned parcels. The Developer has signed a petition requesting the annexation of this streetlight maintenance into Santa Clarita Streetlight Maintenance District No. 1 as Annexation No. 2001-L23. The above annexations will provide for the continued maintenance of these improvements after they are installed and accepted by the City. By signing the petitions, the Developers have waived the time period for holding the public hearing, noticing, and the right to majority protest at the public hearing, and have submitted assessment ballots in favor of the annexations. Thus, the public hearing for the annexations can be held on the same date as the consent calendar items initiating the annexations. It is estimated that the improvements will be accepted after July 1, 2002. The funds for maintenance costs will be collected on the Fiscal Year 2002/2003 Tax Roll. The resolutions declare the City's intention to annex 23551 Magic Mountain Parkway, Tract No. 53114, and 18525 Via Princessa into Streetlight Maintenance District No. 1 as Annexation Nos. 2001-1,21, 2001-L22, and 2001-L23, respectively. The total proposed annual assessment for: • Annexation No. 2001-L21 $150 per lot. • Annexation No. 2001-1,22 $50 per lot. • Annexation No. 2001-L23 $250 per lot. Currently, there are six lots for Annexation No. 2001-L21, 53 proposed units for Annexation No. 2001-L22, and two proposed lots for Annexation No. 2001-L23. The formation of this District is in compliance with Proposition 218. ALTERNATIVE ACTIONS 1. Do not approve the annexation. 2. Other action as determined by the City Council. FISCAL IMPACT The annexation of these territories will provide funding for the maintenance of the street lighting for the territories mentioned above. The estimated revenues collected from these annexations for annual maintenance will be $4,050.00. The hearing will be held by the City of Santa Clarita City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, first floor, on the 23rd day of October 2001, at or after 6:00 p.m. The City Council, pursuant to the Landscaping and Lighting Act of 1972, being a Division of the Streets and Highways Code of the State of California (the "Act"), desires to annex the territory and to levy assessments within Santa Clarita Streetlight Maintenance District No. 1. Proponents, opponents, and any interested persons may appear and be heard on this matter at that time.
