SUBJECT: RESOLUTION INITIATING PROCEEDINGS FOR THE SITE
SPECIFIC STORM DRAINAGE POLLUTION ABATEMENT FEE FOR
THE HIDDEN CREEK DEVELOPMENT WEST OF MCBEAN
PARKWAY AND SOUTH OF COPPERHILL DRIVE (HIDDEN
CREEK) SETTING A TIME AND PLACE FOR A PUBLIC HEARING.

RECOMMENDED ACTION
Adopt a resolution initiating proceedings for the Hidden Creek development Site Specific
Storm Drainage Pollution Abatement Fee and set the public hearing for July 10, 2001.
BACKGROUND
In November 1996, California voters passed Proposition 218 — The Right to Vote on Taxes
Act. As a result, the city must conduct a majority protest hearing and a ballot election
before imposing a Site Specific Storm Drainage Pollution Abatement Fee on the associated
parcel(s). Pursuant to Proposition 218, the property owner, Newhall Land & Farming
Company has submitted a written waiver requesting that the time requirements for
initiating proceedings and conducting the protest and election public hearings be
compressed to shorten the process.
Typically, Proposition 218 requires that if a new fee is imposed on a property, a majority
protest hearing shall be held not less than 45 days after the mailing of the public notice. If
no majority protest occurs, the city shall mail a public notice of the proposed fee with a
ballot to all property owners and hold a public hearing not less than 45 days after the
mailing of the public notice and ballot. If after the closing of the public hearing, property
owners elect to impose a fee, the City Council may adopt a resolution canvassing ballots
and imposing the site specific storm drainage pollution abatement fee. At the request of the
property owner, and pursuant to Proposition 218, the time requirements have been
compressed into a single public hearing.
In addition, the Site Specific Storm Drainage Pollution Abatement Fee will include an
annual inflation adjustment in accordance with the Consumer Price Index (CPI) for Los
Angeles, Long Beach, and Anaheim, for April of each year.

FISCAL IMPACT
The anticipated annual costs associated with the maintenance for the additional water
quality facility located in the Hidden Creek Development is $27,966. Based upon the
proposed development of 275 Single Family Dwellings (SFD), the annual levy will be
$101.69 per parcel. This will result in anticipated additional revenues in the Stormwater
Utility Fund (Fund 456) in the amount of $27,966 to recover the costs of the additional
maintenance. The annual levy of $101.69 per parcel is subject to bi-annual review and
adjustment based on actual expenditures.
