SUBJECT: ANNUAL "CLEAN-UP" OF TITLE 16 "SUBDIVISIONS" AND TITLE
17 "ZONING" OF THE UNIFIED DEVELOPMENT CODE (UDC)

RECOMMENDED ACTION
The City Council receive staff presentation, receive public testimony, close the public
hearing that was opened on January 23, 2001, discuss and adopt a resolution adopting the
negative declaration, introduce an ordinance, and pass to second reading on February 27,
2001.

The public hearing was scheduled to be heard before the City Council on January 23, 2001,
however, was continued to February 13, 2001 at the request of the Council.
On December 19, 2000, the Planning Commission held a public hearing regarding Master
Case 00-397, a request to modify various sections of the Unified Development Code. On
January 16, 2001, the Planning Commission held a public hearing regarding Master Case
00-462; a request to modify the Downtown Newhall Special Standards District within Title
17 "Zoning." The Planning Commission voted unanimously to recommend approval to the
City Council on both items.
ALYSIS
Planning staff periodically reviews the Unified Development Code regarding issues and
new regulations that arise. Planning staff coordinated
divisions, including Redevelopment, Code Enforcement and with other departments andBuilding and Safety to collect
the proposed changes identified on Exhibit A and B. The Ordinance contains changes to
the UDC amending portions of Title 16 and Title 17, which include the Subdivision,
Administration and Zoning sections of the code. The amendments to the Unified
Development Code also include new regulations based on comments that planning staff has
received from the public, Planning Commission and City Council.

The sections which have proposed modifications (Exhibit A and B) are: Park Fees and
Dedication Requirements, Administration,
Development Standards, Special Zones aDefinitions, Permitted Use Charts, Property
nd Standards, Special Uses and Standards,
Parking Standards, Downtown Newhall Special Standards District and Sign Regulations.
Some of the proposed amendments include new language under Hearings and Notifications
to distinguish between the types of hearings and meetings that the City conducts. The
section currently identifies one category of hearing, the new language would add public
meetings, public hearings and administrative hearings and the noticing requirements.
Under Animal Keeping, types of structures have been modified to include barns, corrals,
training arenas to provide consistency with enforcement. An allowance for the keeping of
cats has been added to the animal keeping matrix with a maximum number of cats
permitted depending on square footage of the site. In addition, the footnote pertaining to
the number of dogs permitted if spayed or neutered has been removed and a section will be
added to Title 8 "Animals" of the Municipal Code for additional cats and dogs providing the
animals are altered.
Density bonus requirements would also be changed to allow affordable housing projects
within hillside areas by eliminating the requirement that the project site not be located
within a hillside area provided the proposal meets all of the hillside regulations.
Shared parking has been modified to further define and indicate specific requirements for
shared parking requests. The new language would require a complete parking analysis
subject to review by the Planning Commission.
Downtown Newhall Special Standards District requirements for wall signage would be
changed to permit additional sign height in proportion to the building frontage.
Other changes are proposed to clean-up and clarify existing language within the code. See
the attached summary of changes and exhibit A of the draft ordinance for a complete list of
the proposed modifications previously distributed to the Council.
ADDITIONAL CHANGE
Staff is proposing two changes to the proposed amendments:
Staff is recommending additional language to the proposed requirement for front yard trees
on all new residential developments in section 17.15.020.1. The added language would
permit modification to the tree requirement where not feasible, subject to the Director's
review and approval.
After further review, staff has also determined that banquet facilities should be listed as a
separate category within the UDC and permitted with the approval of a conditional use
permit in commercial districts, a minor use permit is industrial districts and not permitted
within residential districts as previously proposed.
The changes have been made within the attachments.
ALTERNATIVE ACTIONS
1• Council may choose not to adopt the proposed resolution and not introduce the
Proposed ordinance.
2• Other direction as determined by the City Council.

SUMMARY OF CHANGES
The following is a summary of significant changes to the Unified Development Code (UDC),
known as Sections 16 and 17 of the City's Municipal Code. The proposed amendments in their
entirety are attached to Ordinance (attached).

• The existing parkland dedication formula chart would be deleted and the California
Department of Finance population estimates will be used to determine the average number
of persons per unit

• Public hearing, administrative hearing and public meetings would be clearly defined along
with noticing requirements for each type of hearing or meeting before the Planning
Commission
• Expands the public noticing for Minor Use Permits heard by the Planning Commission to
be consistent with other permits heard by the Commission such as, Conditional
Permits and Subdivision maps Use
• A letter describing a basis for appeal would be required for all appeal requests to the
Planning Commission and City Council
• The definition for accessory structure would be modified to clarify no cooking facilities are
permitted in accessory structures unless the structure meets the requirements of a
secondary dwelling unit
• The measurement of setbacks would be clarified for flag lots
• Modifies the permitted use chart for Group Care Facilities to be consistent with State law
• Adds Banquet Facilities to the list of conditionally permitted uses requiring a conditional
use permit within commercial districts and a minor use permit within industrial districts
• New single-family residential development would be required to provide one front yard
tree per unit
• Trails in the Sand Canyon and Placenta Canyon Special Standards Districts would be
required to be provided for new developments in accordance with the Parks Master Plan
• The Downtown Newhall Special Standards District would be modified to permit flexibility
for additional sign height within the downtown redevelopment area
• Cats would be added under the keeping of animals matrix permitting up to eight cats
depending on the size of the lot
• Solar panels would be treated the same as satellite dishes for setbacks and height
requirements
• Auto related uses, such as car washes, would be required to provide vehicle stacking as is
required for fast food restaurants
• Under single-family residential parking, a requirement would be added for new
construction that the garage spaces must be maintained clear of permanent obstructions
such as hot water heaters
• Specific parking requirements standards would be required for instructional schools such
as dance schools, karate classes, etc.

• Parking standards for industrial uses would be modified to provide one space for each
1,000 square feet of warehouse use and one space for each 500 square feet of
manufacturing
• Shared parking requirements would be expanded to require specific information for all
requests that would be heard before the Planning Commission
• "Natural cause" would be clarified for damaged signs that may be repaired to their
previous condition
• Flexibility would be added to the sign ordinance for temporary holiday decorations
