Nay DATE: August 28, 2001 SUBJECT: TRACT NO. 43532, PRIVATE DRAIN (PD) NO. 1869 — TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council adopt a resolution for the transfer and conveyance of the storm drain improvements for Tract No. 43532, Private Drain No. 1869, to Los Angeles County Flood Control District (LACFCD). Direct staff to transmit a copy of this report indicating the date and action taken, and three certified copies of the adopted Resolution to the Building & Safety/Land Development Division at Los Angeles County's Department of Public Works. BACKGROUND The construction, final inspection, and final Notice of Completion for Private Drain (PD) No. 1869 have been completed. The project is located in the Circle J Ranch area (see attached Exhibit "A"). A detailed description of the facilities is depicted on LACFCD's Drawing Nos. 337-F126.1 through 337-F126.9 on file with the Director of Los Angeles County's Department of Public Works. The developer, Pacific Bay Homes (successor in interest to the Ridgedale joint venture), constructed the storm drains in accordance with the agreements and the Faithful Performance Bonds on file with the City. The agreements also provide that the work shall not be deemed complete until approved, accepted as complete, and transferred to the LACFCD for maintenance. The City and County entered into an agreement on March 14, 1989, recorded as Document No. 89-1346418, which provides for the transfer of storm drains. The City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted and approved by the Board of Supervisors for LACFCD, who operates and maintains the storm drains for public use. It is anticipated that the storm drain will be accepted for maintenance by LACFCD in phases. FISCAL The City incurs a long-term fiscal benefit through transferring the maintenance responsibilities for this storm drain to LACFCD.
