ENACT A TEMPORARY URGENCY MORATORIUM ON
TOBACCO PARAPHERNALIA BUSINESSES.

City Council adopt an urgency ordinance establishing a 45 -day moratorium on
tobacco paraphernalia businesses. A four-fifths vote is required for this urgency
action.
BACKGROUND
On April 10, 2001, the City Council conducted the first reading for the Tobacco
Paraphernalia Ordinance. The second reading of that Ordinance is also scheduled
for April 24, 2001.
PROJECT DESCRIPTION
The City Council also has the second reading and adoption of the Tobacco
Paraphernalia Ordinance on its April 24, 2001 agenda. That ordinance will not take
effect until 30 days after adoption. The City has received an application to establish
a tobacco paraphernalia business that could create entitlement prior to the effective
date of the Tobacco Paraphernalia Ordinance. California Government Code section
65858 authorizes the City to adopt an interim ordinance as an urgency measure
prohibiting any uses which may be in conflict with a zoning proposal being
considered by the City. This Ordinance would be adopted in compliance with the
Government Code, and would immediately establish a forty-five day moratorium on
tobacco paraphernalia businesses (as that term is defined in the Tobacco
Paraphernalia Ordinance).

Other action as determined by the City Council.

FISCAL IMPACT
There should be no or minimal impact to the General Fund Budget, as this action
would temporarily prevent the processing of Conditional Use Permits for tobacco
paraphernalia business.
