HomeMy WebLinkAbout2001-11-05 - MINUTES - SPECIAL MTG (2)CITY OF SANTA CLARITA CITY COUNCIL MINUTES OF SPECIAL MEETING 5:00 P. hL NOVEMBER 5, 2001 CALL TO ORDER Mayor Weste called to order the special meeting of the City Council at 5:01 p.m. ROLL CALL All Councilmembers were present with the exception of Councilmember Darcy, who entered the meeting at 5:03 p.m., and Councilmember Smyth. PUBLIC PARTICIPATION There was none. ITEM 2 CLOSED SESSION Carl Newton, City Attorney, advised of the need to conduct a Closed Session for the purpose of holding a: CONFERENCE WITH LEGAL COUNSEL - Anticipated Litigation k Government Code Section 54956.9 (c) - one matter E RECESS AND RECONVENE Mayor Weste recessed the meeting to closed session at 5:03 p.m. and reconvened the meeting at 6:02 p.m. CITY ATTORNEY ANNOUNCEMENT Carl Newton, City Attorney, announced that during Closed Session Council authorized the City to file an administrative proceeding with the U. S. Fish and Wildlife Service, a petition to designate a critical habitat area in the area of the Transit Mixed Concrete Sand and Gravel project. Further, Council authorized the reinitiation of the endangered Species Act litigation to challenge the U. S. Fish and Wildlife Service biological opinion which was recently issued. SOLID WASTE AUDIT Carl Newton, City Attorney, explained the City's standard indemnification requirements and that Ernst & Young is unwilling to provide unlimited indemnification. They will provide general and automobile liability and will consider the establishment of $300,000 coverage. Council recognized that Ernst & Young will provide the additional insured endorsement to the City on its general liability and automobile liability policies. No requests to speak were submitted on this item. Motion by Kellar, second by Darcy, to modify the City's standard indemnification requirement for Ernst & Young (only) to meet the limitation set forth in the Ernst & Young response to the request for proposals, subject to limitations on liability being three times the level of compensation provided by Ernst & Young. Staff to pursue special insurance policy for immediate addition of $1 million coverage to cover risks of loss or liability arising out of the performance of the solid waste audit contract by Ernst & Young.
