HomeMy WebLinkAbout2001-04-24 - ORDINANCES - AMEND SCMC TOBACCO PARAPHERNAL (2)j� ORDINANCE NO. 01-8 f AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING THE SANTA CLARITA MUNICIPAL CODE, BY ADOPTING REGULATIONS FOR TOBACCO PARAPHERNALIA BUSINESSES (UDC AMENDMENT 00-001). WHEREAS, the City of Santa Clarita General Plan requires the implementation of a City of Santa Clarita Unified Development Code to be in compliance with the Governmental Code of the State of California; and WHEREAS, the provisions of the California Environmental Quality Act (CEQA) of 1970, as amended, Public Resources Code Sections 21000-21774, require the evaluation of the Negative Declaration for projects such as amendments to the Unified Development Code; and WHEREAS, a Negative Declaration was prepared, noticed and circulated for public review in compliance with the provisions of CEQA and the City's Environmental Guidelines; and WHEREAS, the proposed amendment further implements the Goals and Policies of the City's General Plan; and WHEREAS, the Planning Commission conducted a public hearing on the proposed amendment on March 6, 2001. At this meeting, the Commission recommended Council to modify the Unified Development Code to regulate tobacco paraphernalia; and WHEREAS, the City Council conducted a public hearing on the proposed amendment on April 10, 2001; and WHEREAS, the amendment will be made in the Permitted Use Chart and Definition sections of the Unified Development Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. The proposed amendments to the Santa Clarita Unified Development Code are consistent with the City of Santa Clarita General Plan and meet the requirements of the Government Code of the State of California. SECTION 2. That the Initial Study and Negative Declaration for this project have been prepared, reviewed, considered, and found complete in accordance with the provisions of CEQA and the City's Environmental Guidelines and the City Council has adopted the Negative Declaration prepared for this project by separate resolution at the April 10, 2001 City Council meeting. SECTION 3. That if any portion of this Ordinance is held to be invalid, that portion shall be stricken and severed, and the remaining portions shall be unaffected and remain in full force and effect. SECTION 4. Section 17.13.050 (General Commercial Uses) of Chapter 17.13 (Permitted Use Charts) of the Santa Clarita Unified Development Code is hereby amended to alphabetize, renumber, and add: Tobacco Paraphernalia Business A RE RVL RL RS RM RMH RH CTC CC CN CO VSR BP IC I X X X X X X X X C C C C C C C C SECTION 5. Section 17.07.010 (Definitions) of Chapter 17.07 of the Santa Clarita Unified Development Code is hereby amended to add the following definition: TOBACCO PARAPHERNALIA BUSINESS shall mean an establishment that devotes more than a two foot by four foot (two feet in depth maximum) section of shelf space for equipment, products, and materials of any kind (excluding lighters and matches) which are intended or designed for use of tobacco, and includes but not limited to the following. 1. Kits intended for use or designed for use in planting, propagating, cultivating, growing or harvesting of any species of tobacco plant. 2. Kits intended for use or designed for use in manufacturing, compounding, converting, producing, processing, or preparing tobacco. 3. Isomerization devices intended for use or designed for use in increasing the potency of any species of tobacco plant. 4. Testing equipment intended for use or designed for use in identifying, or in analyzing the strength, effectiveness or purity of tobacco. 5. Scales and balances intended for use or designed for use in weighing or measuring tobacco. 6. Separation gins and sifters intended for use or designed for use in removing twigs, stems, seeds, or other foreign material from, or in otherwise cleaning or refining, tobacco. 7. Blenders, bowls, containers, spoons, and mixing devices intended for use or designed for use in compounding tobacco substances or substances containing tobacco. 8. Envelopes, pouches, capsules, balloons, and other containers intended for use or designed for use in packaging small quantities of tobacco. 9. Containers and other objects intended for use or designed for use in storing or concealing tobacco. 10. Objects intended for use or designed for use in ingesting, inhaling, or otherwise introducing tobacco into the human body, such as the following: A. Metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes with or without screens, permanent screens, or punctured metal bowls. B. Water pipes. C. Carburetion tubes and devices. D. Smoking and carburetion masks. E. Clips or other devices intended to hold burning material, such as a cigarette, that has become too small or too short to be held in the hand. F. G. Chamber pipes. Carburetor pipes. H. Electric pipes. L Air -driven pipes. J. Chillums. K Bongs. L. Ice pipes or chillers. SECTION 6. That the City Clerk shall certify to the passage of this ordinance and shall cause it to be published in the manner prescribed by law. PASSED AND APPROVED this 24' day of April, 2001.
