AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA,
APPROVING ZONE CHANGE 01-001 (MASTER CASE 01-047) WHICH CHANGES
THE ZONING CLASSIFICATION OF THE SITE FROM ZONE CC (COMMUNITY
COMMERCIAL) TO ZONE RH (RESIDENTIAL HIGH) FOR THE DEVELOPMENT OF A
200 UNIT AFFORDABLE SENIOR HOUSING PROJECT ON A 5.84 ACRE
PROPERTY LOCATED EASTERLY OF SIERRA HIGHWAY AT THE TERMINUS
OF THE PROPOSED FLYING TIGER DRIVE (LOT 4 OF PARCEL MAP 25916)
WHEREAS, the City Council of the City of Santa Clarita does hereby make the
following findings of fact:
a. The applicant proposed and initiated a zone change of vacant property located
easterly of Sierra Highway at the terminus of the proposed Flying Tiger Drive,
for the purpose of redesignating property (lot 4 of Parcel Map 25916) from CC
(Community Commercial) zoning to RH (Residential High) zoning.
b. Such a Zone Change would become effective upon City Council approval of the
General Plan Amendment and Mitigated Negative Declaration.
C. On November 6, 2001, the Planning Commission of the City of Santa Clarita
conducted a duly noticed public hearing for the proposed 200 unit affordable
senior housing project. The public hearing was held at 7:00 p.m. at City Hall,
Council Chambers, 23920 Valencia Boulevard, Santa Clarita. The Planning
Commission closed the public hearing on November 6, 2001 and recommended
that the City Council approve the project including the Zone Change, General
Plan Amendment, Conditional Use Permit, Variance, and Mitigated Negative
Declaration. Notice of said public hearing was given in the manner required by
the Santa Clarita Municipal Code and State Law.
d. The City Council held a duly noticed public hearing for the proposed 200 unit
affordable senior housing project with the associated entitlements, including
Zone Change 01-001 on November 27, 2001.
WHEREAS, based upon the testimony and other evidence received at the hearing, and
upon the study and investigation made by the Planning Commission and on its behalf, the
Commission further finds as follows:
a. The purpose of the proposal is for a change of zoning designation of the project
site from CC (Community Commercial) zoning to RH (Residential High) zoning
within the City of Santa Clarita.
b. The Zone Change has been reviewed for consistency with the City's General
Plan.
C. Public participation and notification requirements pursuant to Sections 65090
and 65391 of the Government Code of the State of California were duly followed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Based upon the foregoing facts and findings in the Initial Study prepared
for the project, the City Council determines as follows:
a. Said study found that the project would not have an adverse impact to the
existing and future environmental resources of the area and a mitigated negative
declaration was prepared.
b. On November 6, 2001, the Planning Commission adopted a recommendation that
the City Council approve Master Case 01-047 which consists of Zone Change 01-
001, General Plan Amendment 01-002, Conditional Use Permit 01-003, Variance
01-002, and the Mitigated Negative Declaration for the project. On November
27, 2001, the City Council approved the General Plan Amendment, Conditional
Use Permit, Variance, and Mitigated Negative Declaration for the project, and
held the first reading of the ordinance for the Zone Change.
SECTION 2. The City Council has considered certain principles and standards, and
determines as follows:
a. That because of the lack of high density residentially zoned property and a need
for more affordable senior housing in the Canyon Country Community within the
City of Santa Clarita, there is a need for the Zone Change to RH (Residential
High) zoning for the area just easterly of Sierra highway at the terminus of
Flying Tiger Drive on lot 4 of Parcel Map 25916 which is consistent with the
objectives of the General Plan, Development Code, and development policies of
the City of Santa Clarita.
b. The public necessity, convenience, general welfare and good planning practice
justifies the Zone Change classification to RH (Residential High) based upon the
fact that the zone change would provide affordable senior housing to the Canyon
Country Community within the City of Santa Clarita. The Zone Change would
be compatible with the existing adjacent residential and commercial uses with
application of the Conditions of Approval and Mitigation Measures.
SECTION 3. The City Council hereby approves Zone Change 01-001 for the 200 unit
affordable senior housing project to be located easterly of Sierra Highway at the terminus of the
proposed Flying Tiger Drive on lot 4 of Parcel Map 25916.
SECTION 4. This Ordinance shall be in full force and effect thirty (30) days from its
passage and adoption.
SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall
cause the same to be published as required by law.
