HomeMy WebLinkAbout2001-08-28 - ORDINANCES - EZ ACCESS DEV PROJ (2)ORDINANCE NO. 01-14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING ZONE CHANGE NO. 00-002 (MASTER CASE 00-205) FOR THE EZ ACCESS LLC DEVELOPMENT PROJECT LOCATED WEST OF DOCKWEILER DRIVE, NORTH OF VALLE DEL ORO AND EAST OF EZ ACCESS SELF -STORAGE WHEREAS, the City Council does hereby make the following findings of fact: a. The applicant, EZ Access LLC, proposed and initiated a zone change on May 19, 2000 of certain uninhabited property located north of the Valle del Oro and east of the existing EZ Access Self -Storage facility as described and shown on Exhibit B, for the purpose of changing the zoning designation from Residential Low (RL) and. PE (Private Education) to RS (Residential Suburban), and expand the CC (Community Commercial) designation boundaries on 55 acres. b. Such a Zone Change would become effective upon City Council approval and adoption of Resolution, adopting the Mitigated Negative Declaration. C. The initial study and Mitigated Negative Declaration prepared for the project is being adopted by separate resolution. d. The Planning Commission held a duly noticed public hearing on the EZ Access LLC Development project entitlements, including Zone Change 00-002 on June 5, 2001. On June 5, 2001, the Planning Commission adopted a recommendation that the City Council approve TTM 53114, adopt the Resolution approving the Mitigated Negative Declaration prepared for the project, approve the zone change, general plan amendment, oak tree permit, minor use permit, and hillside review. Notice of said public hearings was given in the manner required by the Santa Clarita Municipal Code and State law. e. The City Council held a duly noticed public hearing on the EZ Access LLC Development project entitlements, including Zone Change 00-002 on July 10, 2001. WHEREAS, based upon the testimony and other evidence received at the hearing, and upon the study and investigation made by the Planning Commission and City Council and on its behalf the City Council further find as follows: a. The purpose of the proposal is to Zone Change the .project site from Private Education (PE), Residential Low (RL) to Residential Suburban (RS) and expand the boundaries of the CC (Community Commercial) zone on the project site. b. That with this request, the zoning designation and City's General Plan designation for the site would be consistent. C. Public participation and notification requirements pursuant to Sections 65090 and 65391 of the Government Code of the State of California were duly followed. Ordinance Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 3. FINDINGS FOR ZONE CHANGE. Based upon the foregoing facts and findings, the City Council hereby finds as follows: a. The proposed zoned change from RL (Residential Low), PE (Private Education), and CC (Community Commercial) to RS (Residential Suburban) and expand the CC (Community Commercial) boundaries is consistent with the objectives of the City's Unified Development Code and the City's General Plan because the proposed residential development, public school and expansion of the self storage facility is a mixture of uses permitted with the proposed zoning designations, and the uses would be developed in a compatible nature. SECTION 2. The City Council hereby approves Zone Change 00-002 consisting of the EZ Access Development project area to Residential Suburban and expand the boundaries of the CC zone. A map of the zone change is on file in the Planning Division. SECTION 3. This Ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption. SECTION 4. The City Clerk shall certify as to the passage of this Ordinance and cause it to be published in the manner prescribed by law. PASSED AND APPROVED this 28th day of August 2001.
