HomeMy WebLinkAbout2001-04-10 - ORDINANCES - GV/FRIENDLY VALLEY ZC (2){� ORDINANCE NO. 01-7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING ZONE CHANGE NO. 99-003 (MASTER CASE 99-370) FOR THE GOLDEN VALLEY ESTATES, LLC AND FRIENDLY VALLEY RECREATION ASSOCIATION PROJECT LOCATED SOUTH OF MAY WAY AND NORTH FRIENDLY VALLEY AT THE TERMINUS OF BRENDLE WAY WHEREAS, the City Council does hereby make the following findings of fact: a. The applicant, Golden Valley Estates, LLCand Friendly Valley Recreation Association, proposed and initiated a zone change on November 24, 2001 of certain uninhabited property located south of May Way and north of the existing Friendly Valley Community as described and shown on Exhibit A, for the purpose of changing the zoning designation from Residential Low (RL) to Residential Moderate RM with a (PD) Planned Development Overlay Zone on 26.88 acres. b. Such a Zone Change would become effective upon City Council approval and adoption of Resolution, adopting the Mitigated Negative Declaration. C. The Planning Commission held a duly noticed public hearing on the Golden Valley Estates, LLC and Friendly Valley Recreation Association project entitlements, including Zone Change 99-003 on February 6, 2001. On February 6, 2001, the Planning Commission adopted a recommendation that the City Council approve TTM 52385 (22 duplex buildings on 26.88 acres of land), adopt the Resolution approving the Mitigated Negative Declaration prepared for the project, approve the zone change, conditional use permit, and hillside review. Notice of said public hearings was given in the manner required by the Santa Clarita Municipal Code and State law. d. The City Council held a duly noticed public hearing on the Golden Valley Estates, LLC and Friendly Valley Recreation Association project entitlements, including Zone Change 99-003 on March 27, 2001. WHEREAS, based upon the testimony and other evidence received at the hearing, and upon the study and investigation made by the Planning Commission and City Council and on its behalf, the City Council further find as follows: a. The purpose of the proposal is to Zone Change the project site from Residential Low (RL) to Residential Moderate Planned Development RM (PD) zone. b. That the Zone Change has been reviewed for consistency with the City's General Plan. C. Public participation and notification requirements pursuant to Sections 65090 and 65391 of the Government Code of the State of California were duly followed. Ordinance 01-7 Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council has considered certain principals and standards, and determines as follows: a. That a need for the Zone Change to RM (PD) zoning does exist within the area of the subject property and is consistent with the General Plan, Development Code, and development policies of the City of Santa Clarita. ' b. That public necessity, convenience, general welfare and good planning practice justifies the Zone Change classification to RM (PD) based upon existing surrounding land uses and geographical features. C. The initial study and Mitigated Negative Declaration prepared for the project is being adopted by separate resolution. SECTION 2. The City Council hereby approves Zone Change 99-003 consisting of the Golden Valley Estates, LLC and Friendly Valley Recreation Association project area to Residential Moderate Planned Development RM (PD). A map of the zone change is on file in the Planning Division. SECTION 3. This Ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption. Ordinance 01-7 Page 3 SECTION 4. The City Clerk shall certify as to the passage of this Ordinance and cause it to be published in the manner prescribed by law. PASSED AND APPROVED this 10" day of April, 2001.
