HomeMy WebLinkAbout2001-11-27 - ORDINANCES - GVR SIERRA HWY ZONE CHANGE (2)ORDINANCE NO. 01-17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING ZONE CHANGE NO. 01-001 (MASTER CASE O1-037) FOR THE GOLDEN VALLEY ROAD/SIERRA HIGHWAY COMMERCIAL SHOPPING CENTER LOCATED AT THE NORTHEAST CORNER OF SIERRA HIGHWAY AND GOLDEN VALLEY ROAD WHEREAS, the City Council does hereby make the following findings of fact: a. On February 5, 2001 an entitlement was filed by Zephyr Newhall, LP, (the "applicant") with the Planning & Building Services Department and was deemed complete on the following day February 6, 2001. The applicant proposed and initiated a zone 'change of certain uninhabited property located at the northeast corner of Sierra Highway and Golden Valley Road as shown on Exhibit C, for the purpose of redesignating property (Lots 149, 150, 151 of VTTM 48892) from (RSPD) Residential Suburban Planned Development Overlay Zone to (CCPD) Community Commercial Planned Development Overlay Zone. b. Such a Zone Change would become effective upon City Council approval of the General Plan Amendment and Mitigated Negative Declaration. C. The Planning Commission held a duly noticed public hearing on the Golden Valley Road/Sierra Highway Commercial Shopping Center project entitlements, including —Zone Change -01 -001 -on October 16, 2001. The Planning Commission closed the public hearing on October 16, 2001, and recommended that the City Council approve the project including the zone change, general plan amendment, conditional use permit, and mitigated negative declaration. Notice of said public hearing was given in the manner required by the Santa Clarita Municipal Code and State law. d. The City Council held duly noticed public hearing on the Golden Valley Road/Sierra Highway Commercial Shopping Center project entitlements, including Zone Change O1-001 on November 13, 2001. WHEREAS, based upon the testimony and other evidence received at the hearing, and upon the study and investigation made by the Planning Commission and City Council and on its behalf, the City Council further find as follows: a. The purpose of the proposal is to Zone Change the project site from Residential Suburban Planned Development (RSPD) to Community Commercial Planned Development (CCPD) zone. b. That the Zone Change has been reviewed for consistency with the City's General Plan. C. Public participation and notification requirements pursuant to Sections 65090 and 65391 of the Government Code of the State of California were duly followed. Ordinance 01-17 Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION I. Based upon the foregoing facts and findings in the Initial Study prepared for the project, the City Council determines as follows: a. Said study found that the project would not have an adverse impact to the existing and future environmental resources of the area and a mitigated negative declaration was prepared. b. On October 16, 2001, the Planning Commission adopted a recommendation that the City Council approve General Plan Amendment 01-001, Conditional Use Permit 01- 015, Zone Change 01-001, and the Mitigated Negative Declaration for the project. C. On November 13, 2001, the City Council approved the General Plan Amendment, Conditional Use Permit and Mitigated Negative Declaration for the project, and held the first reading of the ordinance for the Zone Change. SECTION 2. The City Council has considered certain principals and standards, and determines as follows: a. That because of the lack of commercially zoned property and a need for more of a balance between commercial and residential within the suri�ounn area, need for the Zone Change to CCPD (Community Commercial Planned Development) zoning does exist within the area of the subject property (Lot 151,150, and 149 of VTTM 48892) and is consistent with the objectives of the General Plan, Development Code, and development policies of the City of Santa Clarita. b. The public necessity, convenience, general welfare and good planning practice justifies the Zone Change classification to CCPD based upon that the zone change would provide a commercial service for the adjacent and future residential neighborhood that is currently not there. The zone change would be compatible with the existing and future adjacent residential community with the conditions of approval and mitigation measures. SECTION 3. The City Council hereby approves Zone Change 01-001 consisting of the Golden Valley Road/Sierra Highway Commercial Shopping Center project area to Community Commercial Planned Development (CCPD). A map of the zone change is attached as Exhibit "C." Ordinance 01-17 Page 3 SECTION 4. This Ordinance shall be in full force and effect thirty (30) days from its passage and adoption. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
