HomeMy WebLinkAbout2001-02-27 - ORDINANCES - TITLE 16 17 UDC (2)ORDINANCE NO. 01-5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING TITLE 16 AND TITLE 17 OF THE SANTA CLARITA MUNICIPAL CODE, ADOPTING VARIOUS AMENDMENTS TO THE UNIFIED DEVELOPMENT CODE (UDC) WHEREAS, the City of Santa Clarita General Plan requires the implementation of the City of Santa Clarita Unified Development Code to be in compliance with the Government Code of the State of California, WHEREAS, the City of Santa Clarita initiated a Unified Development Code Amendment 00-003 (Master Case 00-397) on November 2, 2000 to modify various sections of Title 16 and Title 17 of the City of Santa Clarita Municipal Code (UDC "clean-up); WHEREAS, Unified Development Code Amendment 00-003 includes modifications to the following sections of the UDC: Permits and Applications, Definitions, Zoning, Permitted Use Chart, Residential and Agricultural Standards, Special Zones and Standards, Specific Development Requirements and Parking Standards. The proposed modifications/amendments are attached as (Exhibit A); WHEREAS, the proposed amendments are consistent with and further implement the Goals and Policies of the City of Santa Clarita General Plan; WHEREAS, the Planning Commission conducted a duly noticed public hearing on December 19, 2000 at City Hall, 23920 Valencia Boulevard, Santa Clarita, Ca 91355. At this meeting, the Planning Commission adopted Resolution P00-47, recommending approval of Unified Development Code Amendment Ordinance to the City Council and adoption of the Negative Declaration for the Unified Development Code Amendment 00-003 (UDC "clean-up") to the City Council; WHEREAS, the City of Santa Clarks, initiated a Unified Development Code Amendment 00-004 (Master Case 00-462) on December 21, 2000 to the Newhall Special Standards District requirements of Title 17 of the City of Santa Clarita Municipal Code; WHEREAS, Unified Development Code Amendment 00-004 includes modifications to the following section: Downtown Newhall Special Standards District. The proposed modificationslamendments are attached as (Exhibit B); WHEREAS, the proposed amendments are consistent with and further implement the Goals and Policies of the City of Santa Clarita General Plan; WHEREAS, the Planning Commission conducted a duly noticed public hearing on January 16, 2001 at City Hall, 23920 Valencia Boulevard, Santa Clarita, Ca 91355. At this meeting, the Planning Commission adopted Resolution P00-52, recommending approval of Unified Development Code Amendment Ordinance to the City Council; WHEREAS, on February 13, 2001, the City Council adopted a Negative Declaration under separate resolution for Unified Development Code Amendment 00-003 (UDC "clean-up") and the City Council adopted a notice of exemption for Unified Development Code Amendment 00-004 (Downtown Newhall Special Standards District) because the project is a minor alteration to the signage requirements within the Unified Development Code (UDC) and will have no direct impact on the environment (Indirect physical impacts of construction of on -premise signs are exempt under Section 15311, Class 11a of the California Environmental Quality Act); and VvMREAS, the City Council of the City of Santa Clarita conducted a duly noticed public hearing on January 23, 2001 at City Hail, 23920 Valencia Boulevard, Santa Clarita, Ca 91355. The item was continued to the February 13, 2001 City Council meeting. At this meeting, the City Council introduced an ordinance to modify the Unified Development Code and passed the ordinance to a second reading on February 27, 2001. NOW THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES ORDAIN AS FOLLOWS: SECTION 1. The proposed amendments to the Santa Clarita Unified Development Code are consistent with the City of Santa Clarita General Plan and meet the requirements of the Government Code of the State of California. SECTION 2. The proposed amendments to the Santa Clarita Unified Development Code identified in Exhibits A and B are hereby adopted. SECTION 3. That if any, portion of this ordinance is hold to be invalid, that portion shall be stricken and severed, and the remaining portions shall be unaffected and remain in full force and effect. SECTION 4. That the City Clerk shall certify to the passage of this ordinance and shall cause it to be published in the manner prescribed by law. This shall include living quarters on the same building site as a dwelling, designed or used for housing servants or guests, having no cooking facilities or kitchen and not rented or otherwise used as a separate building. This requirement may be waived or modified by the Director of Planning and Building Services where it is. found to be impractical due to topographical conditions, is not in keeping with the neighborhood or otherwise will not benefit the area.
