HomeMy WebLinkAbout2001-01-09 - RESOLUTIONS - HOMELES SHELT DENIAL MC 00-339 (2)RESOLUTION NO. 01-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DENYING MASTER, CASE 00-339 REQUESTING TO ESTABLISH A HOMELESS SHELTER LOCATED AT 17714 SIERRA HIGHWAY. WHEREAS, the City Council of the City of Santa Clarita (hereafter "City") hereby makes the following findings of fact: A. An application for a conditional use permit was filed on September 18, 2000 by Santa Clarita Community Development Corporation (the "applicant"). The property for which this entitlement has been filed is located at 17714 Sierra Highway. The existing zoning and general plan designations for the property are CC (Community Commercial). B. The applicant has proposed a conditional use permit to allow for a 3,300 square foot homeless shelter in an existing 20,000 foot commercial center. The space would include a kitchen facility, bathrooms, office space, dining facilities, and 38 beds for men and women maximum. The applicant revised the floor plan to provide a maximum of 27 beds. C. The surrounding land uses include a contractors yard to the north, a plumbing contractors yard and residential to the east, existing commercial to the south, and vacant land, auto repair, residential, and a storage yard to the west. D. The project necessitates the filing of a conditional use permit due to the homeless shelter use. E. At the hearing of November 7, 2000, the Planning Commission continued the item to the November 8, 2000 4journed Regular Planning Commission meeting. l`. At the hearing of November 8, 2000, the Planning Commission considered the staff report prepared for this project and received testimony on this proposal. At this meeting, the Planning Commission approved the project. G. On November 9, 2000, an adjacent property owner appealed the decision to the City Council. H. On December 12, 2000, the City Council of the City of Santa Clarity conducted a public hearing and considered the appeal of the Planning Commission's adoption of the Negative Declaration for the homeless shelter, and Conditional Use Permit 00-016(Master Case No. 00-339). The public hearing was held on or before 6:30 p., at City Hall, ornia. Council Chambers, 23920 Valencia Boulevard, Santa Clarity, CalifC F WHEREAS, based upon the above findings of fact, and upon studies and investigations made on behalf of the City Council, the City Council further finds the following Conditional Use Permit findings: A. That the proposed location and operating characteristics of the homeless shelter is not in accordance with the purpose of the Development Code, the purpose of the zone in which the site is located, the Santa Clarita General Plan, and the development policies and standards of the City. That the homeless shelter as proposed would be incompatible in a retail shopping center where retail businesses are directly adjoined to each other. The proposed request would not be consistent General Plan Goal 4 of the Land Use Element which seeks "to ensure that development in the City is consistent with the overall community character and that it contributes in a positive way toward the City's image." Additionally, this request conflicts with General Plan Goal 4.15 of the Land Use Element which seeks to "maintain and/or enhance the character of the various communities through compatible land use standards design guidelines, while promoting an overall identity for the Santa Clarita Valley." The simultaneous functioning of a homeless shelter, bar, and various retail uses all adjoined and within the boundaries of one shopping center would be incompatible with the City's General Plan goals previously mentioned, because such a condition would substantially impact the existing and future businesses in the shopping center. B. That the location and operating characteristics of the development and the conditions under which it would be operated or maintained will be detrimental to the public health, safety, or welfare, or materially injurious to the existing and future businesses within the boundaries of the retail shopping center which includes a horse specialty store, pet store, art gallery, and bar. The proposed operation of the homeless shelter would have a harmful effect on the retail businesses in the shopping center in that area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: SECTION -1 The City Council hereby denies Master Case 00-339. SECTION 2 The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 9th day of January 2001.
