A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA
TO CHANGE THE LAND USE DESIGNATION OF THE GENERAL PLAN (GENERAL
PLAN AMENDMENT 00-003) FOR THE SUBJECT PARCEL FROM THE RESIDENTIAL
LOW (RL) TO INDUSTRIAL COMMERCIAL (IC) AND ADOPTION OF A NEGATIVE
DECLARATION LOCATED AT 17262 SIERRA HIGHWAY
IN THE CITY OF SANTA CLARITA
WHEREAS, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. FINDINGS OF FACT The City Council does hereby find, determine, and declare:
a. On December 1, 2000 an entitlement was filed by the City of Santa Clarita (the
"applicant") with the Planning & Building Services Department which included
the following requests: an amendment to the General Plan Land Use Element
Land Use Map to redesignate approximately 2.16 acres of RL (Residential Low)
land use to IC (Industrial Commercial) land use; a zone change modifying the
Unified Development Code zoning designation and standards of approximately
2.16 acres of property from RL (Residential Low) to IC (Industrial Commercial).
b. The site is located at the 17262 Sierra Highway, in the City of Santa Clarita. The
parcel is described as Assessor Parcel Number 2839-002-026.
C. No development is proposed at this time.
d. The General Plan presently designates the project site as Residential Low, which
corresponds to residential uses with a density of 2.2 units per acre. Upon
approval, the General Plan Land Use Element Land Use Map would be amended
to reflect the site under the IC (Industrial Commercial) General Plan
designation, which corresponds to light industrial and commercial uses.
e. The surrounding land uses consist of single-family residential to the north, east
and south; and a mix of industrial/commercial and self -storage to the west
(across Sierra Highway).
f. This project was reviewed pursuant to the provisions of the California
Environmental Quality Act (CEQA). The City of Santa Clarita prepared an
Initial Study for the project which determined that the proposed will not have
a significant effect on the environment.
h. The Planning Commission held a duly noticed public hearing on this issue on
August 7, 2001. This public hearing was held at 7:00 p.m. at City Hall, 23920
Valencia Boulevard, Santa Clarita.
i. The Planning Commission recommended that the City Council approve the
following entitlements requested under Master Case No. 00-436: General Plan
Amendment 00-003 to the amend the Land Use Element Land Use Map
redesignating the project site from Residential Low (RL) to Industrial
Commercial (IC) and the Negative Declaration.
j. At the hearing described above, the Planning Commission considered staff
presentations, staff reports, applicant presentations, public testimony on the
proposal, and the Negative Declaration prepared for the project.
k. Public participation and notification requirements pursuant to Sections 65090,
65391, and 65854 of the Government Code of the State of California were duly
followed.
1. The City Council held a duly noticed public hearing on this issue on August 13,
2001. This public hearing was held at 7:00 p.m. at City Hall, 23920 Valencia
Boulevard, Santa Clarita.
n. The City Council introduced an ordinance approving a zone change which will
redesignate 2.16 acres of vacant RL (Residential Low) to IC (Industrial
Commercial).
SECTION 2. CALIFORNIA ENVIRONMENTAL 9UALITY ACT FINDINGS Based
upon the testimony and other evidence of received, the Council further finds as follows:
a. An Initial Study and a Negative Declaration for this project have been prepared
and circulated in compliance with the California Environmental Quality Act and
adopted as certified as required by that Act.
b. Said study found that no adverse impact to the eiristing and future
environmental resources of the area would result from the proposal; and
C. The Initial Study has been circulated for review and comment by affected
governmental agencies and the public, and all comments received, if any, have
been considered. The public review period was from July 17, 2001 to August 7,
2001; and
d. The proposed project would not have a significant adverse effect on the
environment and a proposed Negative Declaration was posted and advertised on
July 17, 2001, in accordance with the California Environmental Quality Act
(CEQA); and
e. The Negative Declaration reflects the independent judgment of the City of Santa
Clarita.
f. The City Council, based upon the findings set forth above, hereby finds the
Negative Declaration for this project to have been prepared in compliance with
CEQA.
SECTION 3. GENERAL PLAN FINDINGS Based upon the foregoing, the City Council
does hereby approve the General PlanAmendmentand the General Plan Land Use Map is
hereby amended to designate the subject property to IC (Industrial Commercial)
a. The purpose of the proposal is to amend the General Plan and to change the zone
the project site from City of Santa Clarita RL (Residential Low) to City of Santa
Clarita IC (Industrial Commercial); and
b. That a General Plan Amendment is necessary to change the land use designation
from RL (Residential Low) to IC (Industrial Commercial) future uses on-site; and
SECTION 4. The City Council hereby approves the following entitlements requested
under Master Case No. 00-436: General Plan Amendment 00-003 to the amend the Land Use
Element Land Use Map redesignating the project site from Residential Low (RL) to Industrial
Commercial (IC), including the Negative Declaration as identified in the attached map as
Exhibit "A".
