SUBJECT: CITY MANAGER SICK LEAVE COMPENSATION

RECOMMENDED ACTION
Provide compensation in the amount of $39,353.48 to George A. Caravalho in consideration
of employment contract provisions pertaining to sick leave.
BACKGROUND
As of May 3, 2002, George A. Caravalho is projected to have accrued 116.66 days or
$78,706.97 in sick leave. The City Manager's employment contract, signed
September 4, 1990, Section 12.B. states, "...The Employer shall develop a policy to include
consideration of the PERS option to allow accumulated sick leave time to be added to the
service time for retirement purposes." This policy, and the anticipated benefit resulting
from this program to have been realized by Mr. Caravalho, has not occurred. Given the
agreed to benefit was not provided for during the course of his tenure with the City, it is
recommended that George A. Caravalho be compensated a total of $39,353.48. This amount
is equal to 50 percent of his total projected accrual of sick leave as of May 3, 2002.
Mr. Caravalho has agreed to this compromise in an effort to resolve the outstanding issue
pertaining to his employment agreement and to recognize that amending the PERS
contract would be expensive for the City.
ALTERNATIVE ACTIONS
Adhere to the provisions of the current contract and amend the PERS contract for all City
employees to receive credit for unused sick leave. This would create an expensive unfunded
liability for the City.
FISCAL IMPACT
Funds available in the amount of $39,353.48 are available as a result of salary savings in
position vacancies.
