HomeMy WebLinkAbout2002-11-26 - AGENDA REPORTS - CREEKSIDE N VALENCIA ACCEPT (2)CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR DATE: November 26, 2002 City Manager Approval: Item to be presented by: SUBJECT: TRACT MAP NO. 44831 (Creekside, North Valencia II Annexation) — APPROVAL OF FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION 1) City Council approve Tract Map No. 44831 (Creekside, North Valencia II Annexation); 2) Accept on behalf of the public the offers of dedication for public use and road purposes, the easements for sanitary sewers and sanitary sewer ingress and egress purposes, the easements for covered storm drain, appurtenant structures, ingress and egress purposes, the easements for flood control purposes, the easements for trail purposes and public use, the easements for landscape maintenance purposes, the right to restrict direct vehicular ingress and egress to McBean Parkway, Newhall Ranch Road, and Decoro Drive, the right to prohibit the construction of residential buildings or any other structures within Lots 18 and 20, and the right to prohibit the construction of residential buildings and any other structures, except for recreational facilities on Lots 1, 5, 9, 17, 19 and 21; 3) Make findings as follows: (a) that this project is consistent with the provisions of Sections 66474 and 66474.1 of the Subdivision Map Act and should be approved, and (b) that this proposed subdivision, together with the provisions for this design and improvement, is consistent with the General Plan required by Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division 1 of the Government Code; 4) Instruct the City Treasurer to endorse the Special Assessment Certificate on the face of Tract Map No. 44831, which indicates that all special assessments levied by the City have been paid; 5) Instruct the City Clerk to endorse the Certificate on the face of Tract Map No. 44831, which embodies the approval of said map and the acceptance of the dedications shown thereon; and 6) Instruct the City Engineer to endorse the Agreement for Subdivision Improvements, which provides for the manner in which various improvements described on Tract Map No. 44831, and pursuant to the conditions for the final approval of said map for which security has been posted, shall be constructed and completed. P7rr P Agenda Item: TRACT MAP NO. 44831— APPROVAL OF THE FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION November 26, 2002 — Page 2 BACKGROUND Tract Map No. 44831 (Creekside, North Valencia II Annexation) is the third and final phase of Vesting Tentative Tract Map No. 44831, which was granted approval by the Planning Commission on September 28, 2000, and the City Council on January 11, 2000. A Development Agreement that allows for phasing was approved on April 25, 2000. This phase, consisting of approximately 191.3 acres, is located west of McBean Parkway, north of Newhall Ranch Road, and owned by Newhall Land. This map is creating twenty-two lots (fourteen large residential lots and eight open space lots). Water rights have been secured for all lots. Trail requirements are being met by the construction of a Class I bike trail on the north side of Newhall Ranch Road, a Class I bike trail along the eastern edge of San Francisquito Creek, a 10 -foot wide paseo on the north side of Decoro Drive, and the dedication of easements to the City. The Quimby obligation is being satisfied with the dedication of 17.3 acres of parkland to the City on this map, and the construction of private recreation facilities in accordance with the North Valencia II Development Agreement. A Bridge and Thoroughfare fee of $8,369,968 (based on current fees) shall be paid at building permit issuance, per the Conditions of Approval. (See Fact Sheet) The conditions set by the Planning Commission have been met, and fees have been paid as indicated on the attached Fact Sheet. The map has been checked to the satisfaction of the City Engineer and is ready for City Council approval and acceptance of the dedications. ALTERNATIVE ACTION Staff has not identified any alternative actions that would conform to requirements set forth in the Subdivision Map Act. FISCAL IMPACT The public streets shown on this map will be dedicated to the City. The maintenance of these streets will impact the City's street maintenance budget. Streets: This map is creating four new public streets. B&T Fee: The project is located in the Valencia Bridge and Thoroughfare District; based on a maximum of 363 single-family units, 392 townhouse units, and 163 apartment units, fees totaling $8,369,968 (per current fees) shall be paid at building permit issuance, per the Conditions of Approval, and subject to an increase annually in accordance with the Consumer Price Index per the approved Development Agreement. The payment requirement for these fees may be satisfied in part or whole by B&T credit held by Newhall Land. Transit Fee: $195,000 in fees have been previously paid by the owner within the North Valencia II Annexation and will be retained until all transit improvements are in place; subsequently, the City will reconcile with the owner any difference between the North Valencia II total Transit Fee of $380,000 and the value of the improvements. No additional fees are required prior to the recording of this map. Quimby Fee: The parkland obligation for this map is being met by the dedication of 17.3 acres of public park, 1.1 acres of private park, and private recreation facilities.
