F2002; STPL-5450(012); E.A. 07-931507 — APPROVAL OF PROGRAM SUPPLEMENT NO. M012 AND ADOPTION OF RESOLUTION FOR RAIL RIGHT-OF-WAY DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council approve Program Supplement No. M012 for the construction of an additional 150 parking spaces; adopt a resolution for hazardous waste identification and cleanup for rail right-of-way for the Jan Heidt Metrolink Station parking lot expansion; and authorize the City Manager or designee to execute all documents necessary for the acquisition and construction of the Jan Heidt Metrolink Station parking lot expansion, subject to City Attorney approval. BACKGROUND The Jan Heidt Metrolink Station (Station) parking expansion project encompasses property acquisition, design, and construction of an additional 150 parking spaces for the Station. Program Supplement No. M012 for STPL-5450(012), E.A. No. 07-931507, is the federal funding for the construction of the Jan Heidt Metrolink Station parking lot expansion. Program Supplement No. M012 provides for the funds necessary to reimburse the City for future costs associated with this project. Upon City Council approval of this specific program supplement, the City Manager or his designee is directed to execute this agreement. The design work for the expansion of 150 additional parking spaces for the Jan Heidt Metrolink Station is under way followed by construction. Staff is expecting completion of 100 percent of the Plans, Specifications, and Estimates by the end of Fiscal Year 2001/02. Staff will seek City Council approval for the construction advertisement and an award of construction contract at a later date. The City performed an environmental study, including hazardous waste identification and cleanup for rail right-of-way, and no significant impact was found. The environmental study conducted by the City complied with the National Environmental Policy Act (NEPA) and the California Environmental Quality Act (CEQA), and has sufficient information to Ire Agenda Item:.,/ JAN HEIDT METROLINK STATION PARKING LOT EXPANSION - APPROVAL OF PROGRAM SUPPLEMENT NO. M012 AND ADOPTION OF RESOLUTION FOR RAIL RIGHT-OF-WAY April 23, 2002 — Page 2 enable the Federal Transit Administration to find that a categorical exclusion is appropriate for the project referenced above. Thus, no significant environmental impact was found in the acquired property. As for all federally funded projects, the grant applicant, the City of Santa Clarita, is required to indemnify Caltrans from any future costs associated with cleanup, damages, or liability costs associated with hazardous waste on or below the acquired property's surface (see attached resolution). Upon City Council approval of the resolution for hazardous waste identification and cleanup for rail right-of-way, the City Manager or his designee is directed to execute said resolution. ALTERNATIVE ACTION Other action as determined by the City Council FISCAL IMPACT The City is currently acquiring through eminent domain the necessary right-of-way to accommodate parking expansion at the Jan Heidt Metrolink Station in Newhall. On April 10, 2002, the City Attorney placed a deposit on file with the Court in an amount that is consistent with the appraised value of the right-of-way. Staff will request appropriation of construction -related expenditures associated with the expansion of parking at the station as part of the upcoming annual budget process. Attach your local agency's certified authorizing resolution that clearly identifies the project and the official authorized to execute the agreement. STPL-5450(012) SPECIAL COVENANTS OR REMARKS 08/21/2001 1. All project repair, replacement and maintenance involving the physical condition and the operation of project improvements referred to in Article III MAINTENANCE, of the aforementioned Master Agreement will be the responsibility of the ADMINISTERING AGENCY and shall be performed at regular intervals and as required for efficient operation of the completed project improvements. 2. The ADMINISTERING AGENCY is required to have an audit in accordance with the Single Audit Act and OMB A-133 if it receives a total of $300,000 or more in federal funds in a single fiscal year. The federal funds received under this project are a part of the Catalogue of Federal Domestic Assistance (CFDA) 20.205, Highway Planning and.Research. OMB A-133 superceded OMB A-128 in 1996. A reference to OMB A-128 in a Master Agreement (if any) is superceded by this covenant to conform to OMB A-133. 3. The ADMINISTERING AGENCY agrees that payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration (FHWA) in the Federal -Aid Project Authorization/Agreement or Amendment/Modification (E-76) and accepts any resultant increases in ADMINISTERING AGENCY funds as shown on the Finance Letter, any modification thereof as approved by the Division of Local Assistance, Office of Project Implementation. 4. STATE and ADMINISTERING AGENCY agree that any additional funds which might be made available for new phase(s) of work by future Federal obligations will be encumbered on this PROJECT by use of a STATE approved "Authorization to Proceed" and Finance Letter. ADMINISTERING AGENCY agrees that Federal funds available for reimbursement will be limited to the amounts obligated by the Federal Highway Administration. S. ADMINISTERING AGENCY agrees that it will only proceed with work authorized for specific phase(s) with an "Authorization to Proceed" and will not proceed with future phase(s) of this project prior to receiving an "Authorization to Proceed" from the STATE for that phase(s) unless no further State or Federal funds are needed for those future phase(s). 6.
