SUBJECT: SUPPORT FOR STATE SENATE BILL 994 - LIABILITY: PUBLIC
SKATEBOARD PARKS

RECOMMENDED ACTION
City Council support SB 994, a measure that protects public entities from liability
resulting from injuries that may occur at public skateboard parks.
BACKGROUND
In 1997, Assembly Bill 1296 was passed which stated that public entities would be
protected from liability for injuries sustained by persons at public skateparks from January
1998 until January 2003. The bill determined that skateboarding falls into the category of a
"hazardous recreational activity" much like rock climbing, animal riding and bicycle racing.
The passage of SB 994 would mean public entities remain indemnified until January 2008
under the same guidelines as set forth by AB 1296. SB 994 also specifies that public
entities must continue to provide all records on skatepark incidents to the State Judicial
Council so they may submit a compiled report on all annual filings on March 1, 2007.
Existing law requires operators of skateboard parks to prohibit a person who is not,
equipped with a helmet, elbow pads and knee pads from riding a skateboard in such parks.
It also requires public entities to provide records (including claims and litigation) of all
known or reported injuries incurred by skateboarders at public skateboard parks annually
with the State Judicial Council.
Santa Clarita's skatepark has proven to be very popular among the younger population of
the community which is illustrated by the steady increase in activity at the park. Due to
this popularity, there have been reports of injuries at the skatepark according to the City's
Risk Management Division. It is in the best interests of the City to protect its liability by
supporting SB 994, also supported by the League of California Cities. This will control
legal fees regarding the park, but allow the City to let the park remain open for those who
wish to participate at their own risk.
