Item to be presented by: Christopher Price DATE: September 10, 2002 SUBJECT: FISCAL YEARS 2001-02 AND 2002-03 NEW SIDEWALK CONSTRUCTION, AND FISCAL YEAR 2002-03 REMOVAL AND REPLACEMENT OF SIDEWALK, CURB AND GUTTER, AND ACCESS RAMPS — PROJECT NOS. M0037, M0038, T0016, T0018, AND T0019 —AWARD OF CONSTRUCTION CONTRACT DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council award the construction contract for Fiscal Years 2001-02 and 2002-03 Concrete Rehabilitation Program, Project Nos. M0037, M0038, T0016, T0018, and T0019, to Kalban, Inc. in the amount of $282,675.00, and authorize a contingency in the amount of $28,267.00; authorize a contract change order to Kalban, Inc. in an amount not to exceed $40,000.00 to construct additional access ramps/concrete repairs; and authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The purpose of this project is to upgrade the City's sidewalk system and replace existing damaged concrete pads due to separations caused by factors including uplifting due to tree root infiltration. In addition to various sidewalk improvements, the curb and gutter program will improve drainage flow into local storm drains, thereby improving stormwater quality and minimizing street erosion. The Access Ramp Program will serve our disabled community through the installation of new ramps, and meets the requirements outlined in Title 21 of the Americans with Disabilities Act (ADA). The contracts for these projects are being combined to most efficiently use the available funding. The scope of work for the combined projects (M0037, M0038, T0016, T0018, and T0019) consists of new sidewalk construction on Wiley Canyon Road as an improvement for children attending the local elementary school. Additional public right-of-way improvements include the construction of two new driveway approaches at Creekveiw Park for patrolling purposes, removal and replacement of existing damaged concrete pads due to separations caused by factors including uplifting due to tree root infiltration. Agenda Item: FY 2001-02 AND 2002-03 NEW SIDEWALK CONSTRUCTION, AND FY 2002-03 REMOVAL AND REPLACEMENT OF SIDEWALK, CURB AND GUTTER, AND ACCESS RAMPS — AWARD OF CONSTRUCTION CONTRACT September 10, 2002 — Page 2 The list of locations (Exhibit "B") was generated from residents' telephone calls received by the Field Services and Transportation & Engineering Services Departments, and were also areas identified by City staff as needing restoration. Substantial constraints and controls have been established in the construction documents to reduce potential impacts on local traffic and homeowners during the construction phase. Construction is scheduled to start in October 2002 and is anticipated to be completed within 40 working days after the effective date of the Notice to Proceed. Staff will appoint inspectors to ensure proper work performance by the contractor, as well as handling daily field issues. On July 9, 2002, the City Council approved the plans and specifications and authorized the advertisement for construction bids. On August 28, 2002, the City Clerk's office received bids for the project (Exhibit "X'). The Engineer's Estimate for project construction is $350,000.00. The lowest responsive bid was submitted by Kalban, Inc. in the amount of $282,675.00. At this time, staff is recommending that the City Council authorize additional repair work in an amount not to exceed $40,000.00 as a contract change order for the purpose of constructing additional access ramps and expanding the level of concrete repairs. The opportunity to increase the scope of the project is a result of the competitive bid process and the bid prices submitted by Kalban, Inc. The final construction contract will not exceed the total budget amount of $369,605.56. Staff recommends that the project be awarded to Kalban, Inc., the lowest responsive bidder. Kalban, Inc. possesses a State Contractor's License and is in good standing with the State Contractor's License Board. Kalban, Inc. has done previous capital improvement projects with the City and has provided quality service with minimal construction impact. The bid of Kalban, Inc. was reviewed for accuracy and conformance to the contract documents and was found to be complete. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT Funds for these combined projects have been approved and budgeted in Account Nos. M0037456, M0038201, T0016201, T0018201, and T0019201 for Fiscal Years 2001-02 and 2002-03 in the amount of $369,605.56.
