SUBJECT: ALLOCATION FROM COUNCIL CONTINGENCY FUND FOR
TECHNICAL AND LEGAL CONSULTING ASSISTANCE WITH
SOLID WASTE FRANCHISE BID PROCESS

RECOMMENDED ACTION
Council to approve the appropriation of $100,000 from the Council Contingency Fund,
account number 1240-7401, to the Environmental Services Professional Services Account,
account number 3811-8110 for technical and legal consulting assistance with the
preparation of the Commercial and Residential Solid Waste Franchise Request for
Proposals and franchise agreements.
BACKGROUND
On March 26, 2002 the City Council determined that the residential and commercial solid
waste franchise agreements shall be subject to a public bid process. At the June 4, 2002
Study Session staff presented the Solid Waste Subcommittee proposed process for the
competitive bid.
Staff recommended that the City seek assistance from outside technical consultants and
legal counsel for the preparation of the RFP to obtain the best possible deal. Staff also
determined that many cities benefited from outside assistance and were able to request
reimbursements for their costs by the winning bidder. Council concurred with these
findings and instructed staff to immediately commence with preparation of the RFP for a
consultant to provide technical expertise for the Commercial and Residential Solid Waste
Franchise RFPs and seek outside legal counsel for the preparation of the franchise
agreements.

FISCAL IMPACT
Funds in the amount of $100,000 will be appropriated from the Council Contingency Fund
(1240-7401) to the Environmental Services Professional Services Account (3811-8110) for

technical assistance and legal counsel for the preparation of the commercial and residential
solid waste franchise RFPs and franchise agreements. The City will seek reimbursement
for all related costs including the preparation, distribution, and evaluation of the RFPs and
proposals through the competitive bid process.
