SUBJECT: QUITCLAIM OF STORM DRAIN EASEMENTS TO THE LOS ANGELES
COUNTY FLOOD CONTROL DISTRICT
DEPARTMENT: Transportation & Engineering Services
RECOMMENDED ACTION
City Council adopt a resolution authorizing the Mayor, City Manager, or designee to execute
documents related to the quitclaim of easements for storm drain and/or storm drain ingress and
egress purposes to the Los Angeles County Flood Control District.
BACKGROUND
The primary function of the Los Angeles County Flood Control District (LACFCD) is the control
and conservation of the flood, storm, and other waste water of the District. It has been
determined that the public interest is generally best served when storm drain improvements
and drainage systems are maintained by the LACFCD.
Section 13-3/4 of the Los Angeles County Flood Control Act provides the mechanism for the
transfer of storm drain improvements to the District. The Act does not allow for the direct
transfer of a storm drain improvement from a developer to the LACFCD. On the contrary, the
storm drain improvement must first be accepted by the City, and then transferred from the City
to the LACFCD.
It is for this reason that easements for storm drain and storm drain ingress/egress purposes are
initially dedicated to the City, and then "quitclaimed" to the LACFCD. Literally thousands of
easements have been quitclaimed to the LACFCD for this purpose. Although a formality, the
execution of these documents requires City Council authorization, which generally has been
in the form of a resolution.
Staff has been reviewing ways to streamline the entire storm drain transfer process, and
proposes that a single resolution be adopted authorizing the execution of quitclaims of
easements. While each quitclaim of easement will continue to be reviewed and executed on an
individual basis, passage of this resolution eliminates the requirement to address the City
Council each time a document is prepared.

FISCAL IMPACT
The City incurs a long-term fiscal benefit by streamlining the existing storm drain transfer
process.
