SUBJECT: TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD
CONTROL DISTRICT (LACFCD) — TRACT NO. 49549, MISCELLANEOUS
TRANSFER DRAIN (MTD) NO. 1438

RECOMMENDED ACTION
City Council adopt a resolution for the transfer and conveyance of the storm drain
improvements for Tract No. 49549, Miscellaneous Transfer Drain (MTD) No. 1438, to
Los Angeles County Flood Control District (LACFCD); authorize the Mayor to execute the
attached Quitclaim Deed; and direct staff to transmit a copy of this report indicating the date
and action taken, three copies of the unrecorded Quitclaim Deed properly executed, and three
certified copies of the adopted resolution to the Building & Safety/Land Development Division
at Los Angeles County Department of Public Works.
BACKGROUND
The construction, final inspection, and final Notice of Completion for Miscellaneous Transfer
Drain (MTD) No. 1438 have been completed. The project is located at Via Princessa and
Sheldon Avenue (see attached Exhibit "A" showing the location of improvements). A detailed
description of the facilities is depicted on Los Angeles County Flood Control District Drawing
Nos. 43-F414.1 through 43-F414.2, on file with the Director of Los Angeles County Department
of Public Works. The storm drains were constructed by the developer, Via Princessa, LLC, in
accordance with the agreements and the Faithful Performance Bonds on file with the City. The
agreements also provide that the work shall not be deemed complete until approved, accepted
as complete, and transferred to LACFCD for maintenance.
The City and County entered into an agreement on March 14, 1989, recorded as Document
No. 89-1346418, which provides for the transfer of storm drains. The City Council must
approve a resolution authorizing the transfer to complete the process. The transfer is then
accepted and approved by the Board of Supervisors for LACFCD, who operates and maintains
the storm drains for public use.

FISCAL IMPACT
The City incurs a long-term fiscal benefit through transferring the maintenance responsibilities
for this storm drain to LACFCD.
