SUBJECT: TRACT NO. 52276, MISCELLANEOUS TRANSFER DRAIN (MTD)
N0. 1580 — TRANSFER OF STORM DRAIN TO THE LOS ANGELES
COUNTY FLOOD CONTROL DISTRICT

RECOMMENDED ACTION
City Council adopt a resolution for the transfer and conveyance of the storm drain
improvements for Tract No. 52276, Miscellaneous Transfer Drain No. 1580, to the Los Angeles
County Flood Control District (LACFCD); authorize the Mayor or designee to execute the
attached Quitclaim Deed; and direct staff to transmit a copy of this report indicating the date
and action taken, three copies of the unrecorded Quitclaim Deed properly executed, and three
certified copies of the adopted Resolution to the Building & Safety/Land Development Division
at the Los Angeles County Department of Public Works.
BACKGROUND
The construction, final inspection, and final Notice of Completion for Miscellaneous Transfer
Drain (MTD) No. 1580 have been completed. The project is located at Assessor Parcel
No. 2836-063-008 between Koji Court and Via Princessa in the Canyon Country area (see
attached Exhibit "A!). A detailed description of the facilities is depicted on LACFCD's Drawing
Nos. 43-F419.1 through 43-F419.3, on file with the Director of Los Angeles County's
Department of Public Works. The developer, Pacific Bay Homes, L.L.C., constructed the storm
drain in accordance with the agreements and the Faithful Performance Bonds on file with the
City. The agreements also provide that the work shall not be deemed completed until approved,
accepted as complete, and transferred to LACFCD for maintenance.
The City and County entered into an agreement on August 8, 1991, recorded as Document
No. 91.1322501, which provides for the transfer of storm drains. The City Council must approve
a resolution authorizing the transfer to complete the process. The transfer is then accepted and
approved by the Board of Supervisors for LACFCD, who operates and maintains the storm
drains for public use.

FISCAL IMPACT
The City incurs a long-term fiscal benefit through transferring the maintenance responsibilities
for this storm drain to LACFCD.
