HomeMy WebLinkAbout2002-03-12 - AGENDA REPORTS - SUMMARY VACATE TOWN CENTER APT (2)CONSENT CALENDAR CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented by: DATE: March 12, 2002 SUBJECT: SUMMARY VACATION OF PRIVATE AND FUTURE STREET, TRACT NO. 51931-02, LOTS 17, 18, AND 19 (TOWN CENTER APARTMENTS) DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council adopt a resolution for the summary vacation of private and future street, shown on the attached Exhibits `B," "B-1," and `B-2"; and direct City staff to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles. BACKGROUND The developer, Jefferson II, L.P. a Delaware Limited Partnership, and Riverwalk, Ltd., a Texas Limited Partnership, has requested to vacate a portion of a private and future street easement shown on Tract No. 51931-02, Lots 17, 18, and 19 (Town Center Apartments). The original plan for this area was to construct a trail connection to the river trail located along the tract's north boundary. This trail connection is now planned westerly of the tract boundary. Creekside Road and Fairways Drive were also constructed in this area and now provide adequate traffic circulation for the site. Additionally, no public utilities are located in this area. Therefore, the portion of easement to be vacated will no longer be needed and is considered excess right-of-way. Staff believes that the developer's request is feasible and recommends approval. Under Section 8334 of the Streets and Highways Code, the legislative body of a local agency may summarily vacate a public service easement if the easement is an excess right-of-way. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT None.
