SUBJECT: APPROVE CONTRACTS FOR THE TMC OPPOSITION EFFORT
DEPARTMENT: City Manager
RECOMMENDED ACTION
1. City Council authorize City Manager or designee to execute a new professional services
agreement with Jamison and Sullivan, Inc., for advocacy services, for an amount not to
exceed $46,000.00, subject to City Attorney approval.
2. City Council authorize City Manager or designee to execute a new professional services
agreement with Lennihan Law, for legal expertise regarding appropriative water rights
on an as -needed basis, for an amount not to exceed $40,000.00, subject to City Attorney
approval.
3. City Council authorize City Manager or designee to execute a new professional services
agreement with Budd-Falen Law Offices, for legal expertise regarding mining law on an
as -needed basis, for an amount not to exceed $20,000.00, subject to City Attorney
approval.
BACKGROUND
As the opposition effort against the TMC project in the Soledad Canyon area continues, it
remains necessary to contract with various professionals to support and assist staff. Funds
for this purpose were appropriated in Account 1211-8110 for the FY 2001-2002 budget. The
current non-encumbered/available funds in this account total $192,298.00. The sum
requested for these three agreements is $106,000.00, leaving an available fund balance of
$86,298.00 through June 2002.
Jamison and Sullivan, Inc. expenditures to date total $85,891.60. Approval of an additional
$46,000.00 will bring the contracted total to $131,891.60, which will allow for account
reconciliation, and will provide for continued advocacy services through June 2002.
Services are provided through a monthly retainer.
Lennihan Law supports Burke, Williams and Sorensen in

Budd-Falen Law Offices supports Burke, Williams and Sorensen with mining law expertise,
especially the administrative process used by the federal Bureau of Land Management
when it awards mining contracts. Expenditures to date total $69,183.57. Approval of an
additional $20,000.00 will bring the contracted total to $89,183.57.
ALTERNATIVE ACTIONS
Other direction as determined by the City Council.
FISCAL IMPACT
Overall funding for the City's TMC effort has previously been budgeted in account
1211-8110 for FY 2001-2002, and the requested contractual amounts are available in that
account for these agreements. Accordingly, no additional fiscal impact is anticipated.
