HomeMy WebLinkAbout2002-06-25 - ORDINANCES - SAND CYN JOINT VENTURE SOLEDAD (2)ORDINANCE NO. 02-6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING ZONE CHANGE NO. 97-001 (MASTER CASE 97-069) FOR THE SAND CANYON JOINT VENTURE PROJECT SITE LOCATED AT THE NORTHEAST CORNER OF SOLEDAD CANYON ROAD AND SAND CANYON ROAD WHEREAS, the City Council does hereby make the following findings of fact: a. The applicant proposed and initiated a zone change of certain uninhabited property located at the northeast corner of Soledad Canyon Road and Sand Canyon Road as described and shown on Exhibit A, for the purpose of a zone change from RS (Residential Suburban), RVL (Residential Very Low), CCPD (Community Commercial Planned Development overlay) to RS, MHP (Mobile Home Park), and CCPD. b. Such a Zone Change would become effective upon City Council approval and certification of the Environmental Impact Report. C. The Planning Commission held duly noticed public hearings on the Sand Canyon Joint Venture project entitlements on February 5, 2002, March 5, 2002, and April 2, 2002. The Planning Commission closed the public hearing on April 2, 2002 and continued the item to the April 16, 2002 meeting for the purposes of finalizing their recommendation to the City Council for certification of the FEIR, approval of General Plan Amendment 97-004, Zone Change 97-001, Tentative Tract Map 53074, Conditional Use Permit 97-011, and Hillside Review 97-001. On April 16, 2002, the Planning Commission adopted a recommendation that the City Council approve General Plan Amendment 97-004, Zone Change 97-001, TTM 53074, Conditional UAe Permit 97-011, and Hillside Review 97-001, and consider the Final Environmental Impact Report (FEIR), and ultimately certify the FEIR. Notice of said public hearings was given in the manner required by the Santa Clarita Municipal Code and State law. d. The City Council held a duly noticed public hearing on the Sand Canyon Joint Venture project entitlements, including Zone Change 97-001 on June 11, 2002 which resulted in the item being continued to July 9, 2002. WHEREAS, based upon the testimony and other evidence received at the hearing, and upon the study and investigation made by the Planning Commission and City Council and on its behalf, the City Council further find as follows: a. The purpose of the proposal is to Zone Change the project site from RS (Residential Suburban), RVL (Residential Very Low), and CCPD (Community Commercial Planned Development overlay) to RS, MHP (Mobile Home Park), and CCPD. Ordinance No. 02-6 Page 2 b. That the Zone Change has been reviewed for consistency with the City's General Plan. C. Public participation and notification requirements pursuant to Sections 65090 and 65391 of the Government Code of the State of California were duly followed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Based upon the foregoing facts and findings in the Initial Study prepared for the project, the City Council determines as follows: a. said study found that the project would have an adverse impact to the existing and future environmental resources of the area and an environmental impact report was prepared. b. On April 16, 2002, the Planning Commission adopted a recommendation that the City Council approve Tentative Tract Map 53074, consider the Final Environmental Impact Report (FEIR), and ultimately certify the FEIR and adopt various entitlements, including the zone change. On July 9, 2002, the City Council certified the FEIR and adopted the Statement of Overriding Considerations by separate Resolution. SECTION 2. The City Council has considered certain principals and standards, and determines as follows: a. That a need for the Zone Change to RS, MHP (Mobile Home Park), and CCPD zoning does exist within the area of the subject property and is consistent with the General Plan, Development Code, and development policies of the City of Santa Clarita. b. That public necessity, convenience, general welfare and good planning practice justifies the Zone Change classification to RS, MHP (Mobile Home Park), and CCPD based upon existing land uses and geographical features. SECTION 3. The City Council hereby approves Zone Change 97-001 consisting of the Sand Canyon Joint Venture Project area to RS (Residential Suburban), MHP (Mobile Home Park), and CCPD (Community Commercial Planned Development overlay). A map of the zone change is attached as Exhibit A. SECTION 4. This Ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption. SECTION 5. The City Clerk shall certify as to the passage of this Ordinance and cause it to be published in the manner prescribed by law.
